If you paid for it you technically agreed to the terms and conditions. In Europe it isn't like this though. You can only sign an agreement before paying here.

If everything is like you agreed verbally you would be breaking a contract with the seller.....so a douche move. Equally as douchey if they can't work out something with you

Basically you haven't got the product...so your CC would likely give you a chargeback.

If it is late all bets are off

I understand your predicament with a wrecked car and feel for you but honestly my issue was not trying to get a refund because I no longer "needed" or "wanted" the kit. I was after a refund because the product I received was an epic pile of garbage and after waiting the better part if a year Elliot resorted to holding the kit hostage and ignoring my attempts to communicate. I don't think our situations are the same. I'm not going to put words in the other members mouths that had problems, but I am pretty sure they were in the same situation as me, crappy product or no product at all and nothing but delays.

Wouldn't that be fraudulent or at the very least unethical? Have you tried talking to him? Most folks are understanding when it comes to material losses and will try to work with others for some form of common ground.

At least try the communication route before going gangum on us.

I'm not sure what going gagnam means but I am talking to him he says buying online constitutes agreeing to the terms but I didn't buy online I called him and ordered and the no refund ordeal was not explained to me over the phone and since he did not have a signed receipt from me saying that I agreed dose that not mean I still had the right to back out? To be honest with you if I am truly legally bound then I'm ok with it and I will just have to try to resell the doner but I'm just trying to figure out if I'm truly bound by this or not.

I understand the reference I just don't see how it applys and as far as accepting part if the burden the way I see it is he did not have the right to spend the money I gave him untill I agreed to those terms and so far I have yet to agree to those terms and I should still hold the right to pull out of this agreement.

Since the transaction was by phone, if he took your money without you signing or verbally agreeing to a no-refund clause then you aren't bound legally or ethically

I agree with Team. If you made the order and payment over phone and were not told about the clause then you should be able to get your money back.

If you made the payment after receiving the receipt or a quote with the clause then you agreed to it.

Where did he get this donor engine from?
If it was some random engine, then he was going to have that expense on the next one he built and should be able to pass that expense to his next engine build.

If it was a part ordered just for you, then you should be responsable for the shipping expenses at least.

You should look at it from a business view. He probably has a hour of time into planing and ordering parts for your engine build(probably 50 Bucks). At the same time a good business would just eat the expense to keep the customer happy.

I've been having so much fun with my own SUCCESSFUL turbo install that I almost forgot how horrible the turblown system difference is. Here's to keeping this thread alive... a post for the search engines!

Its not a lost cause. Well Turdblown is, but we shall see soon how this kit does now that the **** ups have been worked out. But I am not expecting amazing results but 350HP should be possible with a solid tune.

The only limitation i can see is the piping size and not having perfect = length runners. A guy should with a bit of banging and the right mani be able to use as big of a turbo as a guy could want down there. I have never liked the idea of a hot turbo in my engine bay.

The guy who got to 400hp on a turblown kit is a friend of mine. He had the top mount set up and his engine only blew when a hose on his wastgate blew off.

I am far from defending turblowns work and all three people i know personally including myself with turblown kits have had to have there set ups completely re-done. I just don't think being a "low mount" is the absolute limiting factor.
