Dork backed into me!

So I've been out in Gillespie county all day Monday riding around on the back roads, climbing to the top of Enchanted Rock and having a generally good day.

Then in Burnet on the way home I'm sitting at a light. The guy in front of me in a Toyota Camry suddenly backs up. Wham! Then he proceeds to drive away sorta hastily as if he isn't pulling into the lot to see what's up. My Wife calls 911 and gets hold of the Burnet Police and they are headed over. The guy pulls into a lot in a little while and the cops arrived immediately.

Amazingly, he did very little to the front of my car. He crunched my front plate and broke the black plastic insert. He left some dirt on the nose and nothing else I could see. Bravo to Mazda.

Well, this assclown has no driver's license, he is driving on someone elses insurance, and he's really evasive to the questions asked by the police. I think he got locked up after I left because the officer told him he was not driving away.

Anyway, I'm having his and my insurance take a look at it to be sure nothing is wrong. I had it over at Premier Mazda today anyway for the recalls and they didn't see anything under the front.

You're lucky he was too stupid to realize that if he lied to the cop and said you rear-ended him while he was stopped at the light, the cop would have no way of knowing the truth (aside from your word against his). That would have made you the at-fault party. Sometimes it's an advantage having accidents with idiots.

youre really lucky, the rx8 front bumper is pretty flimsly and im suprised nothing happened to it. Doesnt take much to crack that plastic bumper.

Very true, except you're forgetting that he had no licnese and is not insured under his own name, so not matter what the situation, that guy is at fault.

So even if that guy were to say u hit him, he is at fault

^ it comes down to who the cop believes. Seeing as you have a license and he doesnt the cop would probably believe you. But if there was a witness to testify that you ran into him it would be your fault regardless of the other guy's license status.

Well, I'll give it to him for his honesty. I really don't want to make trouble for the guy; just a simple country boy, but I do want fair compensation and repairs made to my car.

It turns out the damage was hidden. Down under by the front grill where there are right-angle turns in the plastic it has cracked the bumper cover. My insurance adjuster has documented it. Now I go after his insurance to avoid my deductable. We'll see what happens.

It turns out that his insurance was invalid. Now I don't know what to do...

A) Go to my insurance for uninsured motorist and face the hit in the future.
B) Have my car looked at thoroughly by Mazda and get their estimate. Take him to small claims court.

Frikken redneck! No DL, no insurance.
