well, here it goes. as most of you are aware, rx8evo -robert- has been the center of controversy on this site before. riken and him had some 'miscommunication' over broken tabs.

my transaction with rx8evo began in late november. i purchased an authentic titanium grey MazdaSpeed kit from him under the condition that he would hold onto it until i returned from a college internship in alaska. the only noted damage to the front bumper was an obvious crack about 5 inches long in the lower left lip. the rear diffuser was busted up pretty good as shown in the for sale pics as well. this kit was not sold as new, and i didn't expect that i would get anything in perfect condition.

rx8evo and i have been in very close, friendly communication since the first days of the transaction. he has been very cautious and courteous with regard to payment and shipping details. our initial agreement was that he would ship the kit using greyhound and i would supply him with my stock bumper in return soon after. although at my hesitation for the increase in cost to him, rx8evo generously offered to ship the entire kit using ups freight at considerable cost to him. he made the decision to ensure that the kit would be fully insured and shipped carefully. i commend rx8evo for his care taken during shipping.

when the kit arrived, it was packed carefully into a refigerator-sized box with individually bubblewrapped pieces and packing peanuts. there was no obvious damage to the exterior of the box, and little reason to suspect damage was caused during shipping. i took pictures during the opening of each piece.

the front bumper had significant damage that i was not disclosed and not what i would call 'usual ware'. there were spider cracks throughout the entire bumper, easily visible in sunlight. bare metton gashes and cracks along the lower lip, and many of the tabs were broken off. even half of the left hand turning signal bracket was missing.

the sideskirts were in exactly the condition described. only two small scratches and scuffs on the underside.

the rear diffuser was purchased with full understanding of the poor condition. i never intended to use this piece; only purchased the entire kit together to simplify the transaction and ensure that i could purchase the kit.

the rear wing was equally disappointing as the front bumper. as pictures in my other thread show, it is in terrible condition and i highly doubt its authenticity. rx8evo recently reminded me via phone that he told me it was repainted. however, i do not recall ever having any conversation over the rear wing, other than our email communication in which he said it was 'perfect condition'. i also don't recall receiving a picture of the rear wing base, which clearly shows that the paint does not match. this may be a miscommunication on my part, but it does not excuse the poor quality of repair that is obvious to anyone who sees the pictures.

i proposed a solution to rx8evo in which he were to pay for half of the front bumper repair -228.80-. i offered to ship the rear wing base back at his cost. with the poor condition of the wing, and misrepresented front bumper, i thought that this was more than reasonable. i didn't want a refund, since the cost of return shipping would cost either of us more than the repair, but i offered to return all of it -minus the sideskirts, because they were just as described- for a partial refund.

he refused the offer, and suggested that i return the entire kit, at my shipping cost, for a refund. i have not heard from him since. i went ahead and repaired the kit, since i didn't expect to find any solution with him.



i wrote Zoom44 to let him know about the situation a while back, so hopefully he can help keep this thread civilized.

sorry to hear it Texak, but can't say I'm all surprised. Rx8evo doesn't exactly have a steller selling record.

our transaction was way before the riken-evo mess. i think i was the first one to buy anything from him. i just didn't receive it till recently.

up until i received the kit and found that it was damaged, we had great communication. he seems like a genuinely nice guy. i wanted to withhold my judgement of robert until after i received it and saw for myself. never would i have thought that robert would screw me like this.

robert will soon have a new addition to his family, but being desperately short on cash does not give a person the right to conduct business dishonestly. it's not my fault that he misrepresented his stuff. he still has a responsibility to make good on the transaction, and repair the kit to the condition described.

i don't feel i have the right to tell someone how to spend their money, but it's hard to take someone seriously when they say they can't afford to pay 230 bucks but continue to drive their 06 Shinka

i wouldn't suggest banning robert because i would like to keep this line of communication open to him. if he cares to make things right, i would offer him this public forum to discuss a resolution openly.

A ban wont accomplish anything. Allow him to remain with his shame and lets hope he takes the high road and makes good on his mistakes. He can do this and at least be on the road to recovering a rep or he can do what most of the past shady seller ***** do and run away and hide.

Yeah, if someone feels 'threatened' they can complain to the police and the police may believe him. I once threatened a guy on VM who was bothering an old girl friend with calling the police if he didn't leave her alone. The police came after me because he 'felt threatened' even though I only threatened him with calling the police. There was no dispute as to the content of my threat because he had saved my voicemail. I still had to go to court. When he played my VM threat, the judge was incredulous.

I bought a jack from RX8evo and it came as described with fast shipping. But, the condition of a jack is not sensitive by any measure compared to body panels - if I had read all of this, I may not have purchased with him...sorry to hear of your experience.

well in my PERSONAL opinion- not the opinion of the forum, its management or its owners- robert is big scammer. i dotn believe you will ever se a dime from him without taking him to court. he always has some excuse and LOOOOOOONNNNNGGGG LLLLOOOONNNNNGG WINDED explanation. Anybody that needs that many words to say so little is obviously hiding behind the words.

take him to court. he's never selling anything on here again. and his threats of going to the police over perceived threats from you are just blather to try to scare you away. go file in small claims as fast as you can fill out the forms.

edit- question for legal types- is there some federal statute invoked here by this being done over the internet through the mail between different states type fraud?
