thank you RIWWP i am going to try this out. My car is just over 80k now but when i took it was under 80k so if i bring my paperwork that states it was below 80k before i should be fine right? Should i take it to the same place or a different place?

so from what i have read it looks like what you say is true that they overlap and my car should be covered by both.

ok bad news again so i called the number in the post you posted and the lady said that if you have a CA car then you only have the CA warranty. She said it's just telling you what you do have if you have a federal car.

I know this has been 2 weeks ago, however:

Did you ever pose this question to Mazda North American Operations with a simple phone call?

If it is being refused warranty coverage erroneously then that dealer could face at least some sort of repremand.

800-222-5500. Good luck. Be clear and concise. Let them know that you believe your emission equipment to be under warranty through 80k miles and were wondering why your dealer would not honor that.

just had my CAT replaced and my mileage was just over 80000 but Mazda NA authorized the warranty replacement. Didnt cost me a penny. Push for it or take it to another dealer.

so what should i say? As stated before they said my car has the CA emissions warranty and not the federal which is a 7 year 70k. Im going to call today

Also did you call them and ask them to authorize it? If so what did you say?

How old are you? You were given the phone # yesterday & you are still asking about it. What is so hard about calling Mazda NA & just telling them what is going on? So many people have already tried to help you on this.

No offense SGT, but you need to take a bit more of a personal stake in this.

10 PMs that I still have record of between May 3rd and May 7th, trying to help you out with advice and information on this, and most of what I was telling you in the end was getting repetitive and stuff that you can do yourself in research.

2 weeks later and you still aren't really doing anything....

If you aren't willing to do the legwork and actually make the phone calls, then it doesn't matter what we will suggest that you do. At some point, you are going to have to actually do something. Even if that is just eventually calling a tow truck for your 8 or walking home.

1. Actually I have been doing work calling around different dealerships, trying to find a cat to buy, figuring out which cat i should buy and everything.

2. As stated before everyone in this world is not a car person, some people don't know about car parts and stuff like that.

3. I was just trying to figure out what other people have said so i could use it as well as what im going to say.

4. Don't really understand why people are asking how old I am lol people get ridiculous on forums sometimes and it's funny to me.

5. My car is running im just asking help because I don't want to cause more damage to my car.

People on here know i have been looking around everyday for a cat to buy or some help. I don't get how people can tell me I have done nothing when you don't even have any idea on what I have been doing.

and to this, hey well you know I do have a life and a job so I don't have all day to do this, I stated I would be calling today. Yes I do ask alot of questions if you have a problem with it then don't answer them plain and simple. I just got this car so i figured you guys know way about it then i do.

Just to make things clear....

1. You have been driving your 8 for damn near a month with a bad cat.
2. You are given several options:
2a. Call the dealership (done, got no where)
2b. Call a lawyer (most will give you a free consult if you have a direct/pointed question. ie: Is federal law covering the cat or not?)
2c. Call Mazda NA
2d. Several replacement options have been mentioned along with pros and cons for them.

Man up and take care of this ****. The longer you drive with a bad cat, the greater damage you WILL DO to your 8. It should take all of 1 hour to get your answers to the options listed (2a-2d above) unless you are more than a few crayons short of a full box; in which case you should sell the 8 and take public transportation.

Man I feel for your pain, I took my 8 in for service and they told me that my cat was bad..but they also said that they will fix it at no cost under the emissions warranty. Im taking mine in tomorrow morning and was promise to have it back by 130pm.. my process only took me a week, sorry you havent being able to get your problem in order. But Good Luck

Really an hour to take care of everything lol your funny man. Yes everyone has helped alot with pros and cons and I have taken them into consideration and am currently searching for a cat to purchase. Just because I don't post that you guys should not assume that im not doing anything to resolve this situation.

I didn't bring this thread back to life might I add someone else did and did it to help me out which I thank him for that. I just got advised yesterday to call Mazda NA.

Anyways aside from all this flaming im receiving update on the situation I called Mazda NA and they took all my information and I told them everything and they are calling the dealership I took my car to and will call me back with an update tomorrow.

Those schmucks at the dealership know the law and they are deliberately trying to rip you off. They should be prosecuted. I doubt Mazda NA will try to get away with that BS, but if they do, contact California Air Resources Board directly. Hell, call 'em anyway so they ream these dealers a new one. You are covered by the 8/80,000 mile cat warranty. The CA emissions law gives you MORE coverage rights than the Fed law, not less!

wow if i would have had this info you just posted everything would have been taken care of a long time ago lol.

But anyways drum roll please...................

The dealership was wrong and they are going to replace my cat for me and refund me my $100 thank god. I would like to thank everyone that helped me along this lengthily journey lol. Finally this issue is resolved and you guys don't have to worry about me anymore lol. If I cause an inconvenience to anyone I apologize I was just trying to get as much help as I could and get the situation dealt with.

It is the manufacturer that is responsible for the warranty work, ergo the dealership that has to perform it.

Seriously, print out and read the text file in entirety and take it with you if you must.

It just means that for 0 through 70,000 miles, you had it covered under both. For 70,001 to 80,000 miles, you only have it covered under federal.

At no point in any of those links and the texts say that your federal cat warranty is voided and replaced with the CA warranty. So both apply. Think of it like an extended warranty. You have both up to a certain point, then one drops and the other keeps going.

If the dealership refuses, call a lawyer, I'm sure you can find one that would happily fight it for you. It's a cake walk for a lawyer.

That's from CA's ARB site, and pretty clearly states that Federal law still covers to 80k. They overlap, they do not cancel out.

WOW!!! is everyone on forums this sensitive? I said thanks to everyone that helped me plenty of times. Since you want act like this none of those links say that the CA and the federal are both in tact. It says your state or local government requires that you repair the vehicle. It says state OR local government not both. The one this guy posted clearly states it.

This emissions warranty is an addition to the Federal Emissions Warranty and the Federal Emissions Warranty takes precedents over the California Emissions Warranty.

As ive said thanks to everyone im done arguing I dont even see the sense or point in the last post you just posted RIWWP? I told you, you helped me alot I don't even get it man. I did not post that to offend you or anyone else that helped shessh man.

bad cat

Well after a couple of hours, the mazda dealership took my car and had it back to me in about 5 hours...I seen a incredible difference in the feel of my car..hope you can get your issue taken care of.

yep taking my car to the dealership on Tuesday they should have it done by Thursday at the latest.
