what is the limit is it 80k exactly or right before 81k?

Check to see if your dealership does state emissions testing. If not, then go to a place and have them run a test to verify your cat is bad (both OBD and emissions test).

Hell, it doesn't even have to pass (from http://www.epa.gov/oms/consumer/warr95fs.txt ):

"What If the Dealer Claims That My Vehicle Can Pass the I/M Test
Without Repair?

The law does not require that you fail every I/M test in order to
trigger the warranty. If a valid test shows that you have an emission
problem or there is a defective part, you should get it fixed, while
your vehicle is still within the warranty period. Otherwise, you
might fail a future test because of the same problem and have to pay
for the repair yourself. If you doubt your original test results or
the dealer's results or diagnosis, you can always get another opinion
from another dealer or your I/M program."

It is the manufacturer that is responsible for the warranty work, ergo the dealership that has to perform it.

Seriously, print out and read the text file in entirety and take it with you if you must.

Thanks for all of the info but I just checked my cars mileage and it is 79974 exact. The dealership service departments are closed until tomorrow and I have to drive to work tomorrow what do i do now?

Call the service department tomorrow and set up a time to get it repaired, tell them it is toast and it has been confirmed with a price tag, but, "being that I am still under warranty I would prefer to get that taken care of immediately before additionnal damage is done."
-stress that your car has a substantial loss of power.
take a cab or get a ride

Thanks but the thing is that by the time I get home from work tomorrow because I have to drive it will be over 80k.

"The Clean Air Act mandates that the catalytic converter in my car is warranted for 8 years or 80,000 miles. You say my cat is bad; fix it!"

The text document describes the conditions of it and what grounds the dealership may have to deny the work. If these conditions are not the case, then you have a valid claim. If they STILL deny it, then there are instructions on how to escalate the matter.

considering the price of this service if the car goes over 80k, I ould catch a ride to work, take a cab, rent a car, or take a day off, anything to keep from bumping the car over 80k. Just my opinion.

If you still have the claim paperwork from when you took your car in for your concern, that should be sufficient evidence that you brought the car in for the problem prior to hitting 80k miles.

cool maskerferret that should work right? I do still have the paperwork and it was under 80k when i took it in which was yesterday.

Yes; don't lose that paperwork! Take it in with the car (along with a printout of the EPA document - http://www.epa.gov/oms/consumer/warr95fs.txt ) to the dealership as soon as you can.

Make sure you fully understand everything in that EPA document before you go. You don't need to show them this, but if they give you grief about the issue that goes against what's in the document, then show it to them.

Late answer: Any Mazda dealership. But in your specific case, I would take it back to the same dealership that told you the cat needed replacing.

ok so bad news they said my car is a 7 year 70k California emissions warranty. So now im going to call the dealership i got the car from because I got the car only a few months ago and the CAT should not be gong bad already.

so if i buy a new cat and put it in i should be fine? I don't have to worry about any misfire right because my check engine light is not blinking

The warranty on the cat is 8 yrs/80K miles by federal law. This would supersede CA law.

they pulled the VIN on my car and said mine is CA emissions

is the federal law for every car? Because like i said they said mine was not federal
