My impression from the Mazda Rep that I met last weekend was that there are still driving spots available - this is basically going to be a RX-8/MX-5 meet.
Here's the PDF and the link for registration. I just registered and it didn't say anything about being full, so I guess I'm in.

I saw that. You do have a point, that's why I never brought my car in for anything other than TSB and warranty work. Not even alignment. I don't need them to know I'm doing custom spec for autox, and give them a reason to refuse warranty work.
I too think it's a bunch of BS. It's a driving school, not racing. They are penalizing people for using the car properly and be responsible doing so. I like to see them deny warranty work for street racing, or some little old lady keep the car below 3k rpm thinking it'll blow.
The event is sponsered by Mazda, so I'm sure if they want to trace it, they have our name, address and everything and we're screwed anyway. It's mind blowing to think a company makes a sport car and void the warranty for using it.

What people need to understand is that they can only void your warranty if, 1. You race your car (unfortunately most autox do count as racing since they are timed) 2. they prove you misused or abused the car at a HPDE. Since they don't state what is misuse and abuse it gets tricky. Or you tow stuff around. When it comes to HPDE's it just means if they give you a hard time you will need to fight hard and possible get a lawyer. Since most lawsuit lawyers will only take a case if they think they can win, since they only get paid if they do. Worst case you lose and have to pay for repairs, best case. I work in the contracts department of my company, I review pharmaceutical legal contracts all day long so I showed the warranty booklet to our corporate attorney. He said that the way the wording used implies that you must participate in a competitive timed event in order for them to void your warranty. The part about misuse and abuse is vague and would definitely give any owner a fighting chance to take their case to court if they voided for participating in a HPDE or if Mazda ever used misuse and abuse as the reason to deny warranty work. Now if a lawyer is willing to take that case is a different story. Just so you know he is a 20 year corporate attorney for a fortune 500 company.
If you want to be technical no warranty is worth the paper its written on until someone within the company that is providing the warranty validates it and authorizes the repair.
And the reason the wording of "misuse and abuse" is vague is so they don't have to list a specific section of "this is what we consider misuse and abuse: X or XXX or xXx" and have the chance for some owner to , for example, get up to take a leak and sue because the cruise control didn't keep his Winnebago from crashing.
Its worded how it is for a reason and that is so it is all encompassing without having to try to anticipate all the stupid things Americans are going to try to do to their car and expect Mazda to fix it on their dime.

That's exactly why our corporate attorney said that in a case with misuse and abuse you have to threaten them with a lawsuit. The object according to him is to make them fighting the lawsuit for expensive than paying for the work. Especially since the clause is so vague that either party can win. See lawyers are a good thing every now and then
Just make sure you take off all the race tires and numbers off before taking it to the dealer
I honestly believe if something would happen to a stock engine during a 15min track session or 30-60 sec of autox run, it's going to happen on the street at some point. Now if one is beating the crap out of it during those time, that's a different story. Like mac11 said, they have to cover their *** somehow on paper so people can't drive like idiot and claim Mazda for their stupidity. Although proofing a misuse/abuse could be difficult unless something obvious like running out of oil.
Bottom line is, the less your dealer knows, the better. And if the time comes (knock on wood), just play dumb and let them figure the car out...."I don't know what happened, it just stopped"...and if they're being stupid, call devildog and get his lawyer.

The rep I met that informed me about this event is a pretty good guy. I wouldn't be too worried about this and Mazda voiding the warranty. They're the ones inviting us to come and drive the cars on track.
Only reason I have not signed up is becuase it looks like I will still be in NY that weekend.

We'll see...I might have to back out. Too much going on next month. $150 + 3 tanks of gas (at least)+ new SA helmet makes an expensive weekend.

OK kids, the organizing queen is back! Was the rep you were talking to Steve Rotonda? If so, he was telling me about this event a little while back. I'll email him and see if I can get any info besides the stuff listed on the miata website. Wonder if 8's can get a discounted rate like Miata people are? I'll ask and report back :salute:

I got confused as the autox fees are based on membership to Windy City Miata and thought that was in reference to the track time as well.
