Sorry to see and hear about that.
The first thing........was it his fault.... if he was hit from behind and pushed into the other car then it could be half his for being close enough to the one in front but the guy that hit the back should be his insurance. Was anybody give a ticket for the accident?
I used to own a Midas franchise and at that time it was up to the individual store how to start and inspection. If someone just brought in a car and said they had some brake problems then we would definately test drive it first. It could be company policy now to always test drive, I don't know.

Actually, as long as he is employed by Midas and doing company business (test drive) they ARE responsible for his actions. The blame is on them for having less than professional employee's and in my opinion dumbasses working for them.
