After reading all this, below is just my personal view.
It was a mistake to issue cheque in the salesman name. The salesman said it was a personal loan. (Lesson for all to learn here)
As the salesman represents the Co. so when he said it’s for the bodykit, Co. should honor it.
But the above is not in black and white. So it will be words vs words in court.
It’s a good thing you sign the IOU, it goes to show the Co. recognized the salesman had collected money from you for the RX8.
Not sure what kind of IOU you sign, maybe can post here.
But no worry about the IOU, as you only guarantee for $2,800 if the salesman don’t pay up.
Now how much had the salesman repaid to the Co. is in question.
The Co. have to show proof that the salesman did not pay, will not pay, and not able to pay in the future. Hence the Co. has to take the salesman to court and bankrupt him. I don’t think is worth for the Co.. Even so after bankrupt the salesman still has to repay till discharged.
Only unless the salesman had repaid less then $2,800 and died then you might have to honor the guarantee.
As long as the salesman is alive, the guarantee should not be activated. (Unless otherwise stated in the IOU which I do not know)
Since no loss on your part, and I believe you and the Co. wants to ‘big issue become small issue become no issue’.
Hence you don’t do anything, let the Co take all the actions if it wants, and you just keep all the documents in order.

So I took the car and signed the IOU that the company wrote……………… Lastly, the salesman who cheated me of the money, currently has disconnected his previous handphone, and failed to pay the monthly installment he agreed with the company on the $8k. I was than called up to ask to pay the balance share of $2800 which was agreed on my part.

my point of view...
1. salesman represents the company.
2. salesman cheats, isn't the company responsible for their representatives?
3. do companies allow salesman to deal "extra deals" outside of the company during campany time and during a transaction?
4. posting such statement

doesn't it just means duress to supress us from not commenting?? Or infringement of rights to freedom of speech?

Have decided to hand over the issue to CASE which they are handling now... They will need a couple of weeks to process the paper work... should be soon...
