Tranny problem.

Tranny problem.
I took my car into the dealership 2 days ago for LOF and tire rotation and balance. I also asked them to take a look at the transmission because sometimes it would hesitate going into third gear at higher rpms.
They called me and said I have a broken clutch bracket and a bad master cylinder. They said the repairs would be 700. I have an extended warranty, but I believed it would not cover the repair because the parts were not actually broken yet. I paid my bill over the phone and they said I could come get my car.
When I showed up yesterday afternoon the car would not go into any gear at all, and the clutch pedal had allmost no play. I immediately told the manager and he went into defense mode. He called the tech, who told him he dosen't know how I got the car there in the first place, and all he did was put the car on a lift to look underneath it. He told me he would split the labor with me, but I didn't bite on anything he was saying.
He said he'll see what he can do and call me tommorow. I'm not sure if I should take whatever he offers me, or get a lawyer. Any advice would be helpfull

The hestiate in 3rd gear is a KNOWN issue. Search for TSB
You dont even have to pay for them in the first place, because its all known problem.
Print the TSB out, Bring it in , and ask for your money back. Cuz what they did was they bullshit you to get money outa ur pocket

Power!!
Bring in the TSB's and ask them why this was not covered under warranty. Additionally your master cylinder is for your brakes. I assume they mean your clutch slave cylinder. If this is not attached properly to the trans. then you probably would not be able to shift it in to gear. Bottom line is the car is worse now then when you brought it in so A: they didn't fix it, and B:you shouldn't be paying for them to make the car worse.
And just because something isn't broke yet is not an excuse to ignore the warranty. If it is damaged or not functioning properly it should be replaced and covered.

Okay guys here is the update. The manager won't be back untill tuesday. He left a message for me with his service writer offering to repair the clutch slave and bracket for 400 bucks plus tax. I do not believe I should pay anything. I will look up the tsb for hesitating in 3rd gear and report back. By the way, LOF is lube, oil, and filter. All I paid for was that and a tire rotation. I'm pretty sure the tech was pissed because they tried to make me pay a $140 diagnostic charge, but I refused because the service writer never told me about it and I never signed anything when I left the car there.
