Unhappy Rough night maybe be TOTALED??

Well I am a newbie to the site. I was driving home from Arizona on early Christmas Eve morning and was tooling along when a truck was coming up on the edge of the road. I was in the slow lane running around 65 mph so I tapped my brakes to let the cruise off and started coasting. I was running around 55 when the truck started to come up on the road so I changed lanes to the fast lane when BAM I hit a car that had just wrecked into the wall between the lanes. He was setting sideways in the road from when he had hit the wall and spun around. He had no lights on at all and it was still around 2 am. I hit him and took myself sideways in the road and slammed into the wall as well. I came to a stop then and had to climb out of my drivers side window. The front airbags did not deploy but the side one did. I now need a new front nose, hood, front fender, both drivers side doors, rear quarter panel, back bumper, front wheels where cracked as well as the windshield. I am ok minus and big bruise on my left arm and busted knuckles but the car took the impact very well.... so cudos to Mazda for building a good quality car. I am not sure if they will total it or not. It's color is Black Majic so it should be east to paint I hope!!!

Depends on if the frame is bent or not most of the time to be called a total. Was the other driver still in his car that you hit? I'm suprised there were no flares or people flagging drivers down.

modforce, I am truly sorry to here this. First of all I'm glad you are OK. That must have been a frightening experience. Did you have time to even see the car before impact? Judging by the speed at which you were traveling and the amount of damage I think it is safe to say this is a total. Many accidents with only front end damage not even getting into the doors become totals. I wish you the best of luck and I hope your not too sore. Please keep us posted.

No, I never even saw the car. No flares or anything was out. I was totally unaware of the other car. So I was totally surprised. I did make it home for Christmas so that is a great thing. I wanted to be here for my wife and kids and that was the first thing that went through my mind was them then it was just maintain the car and not go over over the edge of the road. There was a drop off of about 18 feet I guess. God was with me for sure.

Simply amazing how well the 8 protects it's occupants. I've read many post of accidents and very few injuries. You are very lucky.

Wow. I'm sorry to hear man. Here I am complaining that my car won't start when others are having it worse with their 8. Definitely glad you are home safe and the materialistic object can be replaced. Sorry to hear, hope everything works out well for you. Merry Christmas and/or Happy Holidays.

Should be a write-off with damage like that...thank God for the great occupant protection in this car

Whoever left the car unattended is actualy responsible for moving the car off the road, or marking the scene with flares.
The owner of that car wrecked on the side of the road should have been cited for wreckless endangerment.

The D.O.T should have been aware of the wreck also, and made steps to clear the accident, or mark it with flares.

The other guys front end was crunched up and the truck was trying to get his lights on the car to warn the on coming traffic but the truck was donw on the hill and his lights was shining up in the air so I was not able to even see the car. I was totally blinded sided by the inpact of my car into the other car for sure. As I hit it the first thought through my head was my wife and daughters then it was oh-crap there is a big drop-off there that I can not go over or else I was sure I would roll the car. I am not to sore at all but I want to go to a chiropractor as my neck is still alittle sore. The side air bag done a number on my left arm. One good air bag equals one big Bruise!! BUt I will take that over a broken arm any day. I am not sure why he did not have his lights on but the only lights I saw was from a truck backing up on the side of the road.

Good thing you're ok. The RX-8 has one of the highest safty scores, as you probably well know by now. I hope to ever have it happen to me, but if it did I feel that I'd be safe.

Nope, I never got sore. I miss my 8 alot but the wife really wants me to get a truck for our business now so I am looking in that direction. The insurance is very slow here.

What was the outcome to this, did the insurance come through with the money, or are you still waiting? Oh and how about those pics you said you would post?

So I just read this thread, and I saw a lot of things about the guy with the original wreck being guilty of reckless endangerment. I have to ask further about this.

Suppose it were me in the first car. In whatever way, I wreck the car at 2am, leaving it in a dark and hazardous position. Let's say the car is demaged sufficiently that the lights don't work when I try to put them on. I don't have flares. I try to push the car out of the way but am unable to do so. I don't have a functioning cell phone. What can I *possibly* do at that point but leave the scene and try to find a phone and call for help? What should I do to not be guilty of reckless endangerment?

Calling the police and letting them know of the problem and mentioning that there are no lights and/or whatever else that has created the hazard. Doesn't mean you aren't responsible for hte other person's accident but it would most likely get you out of the reckless endangerment thing since you reported it.

We are still waiting to get this done. I have to get a lawyer it's looking like. The other guys insurance is not paying they feel that there client was not at fault since the car was wrecked prior to the accident and there was no lights on. They feel like it should fall back on the first guy that started the accident from the get go. I totally dissagree thus the reason for the lawyer. Now my car is about 8 hours from my house and the lender is getting involved and they are evaluating the situation!!!! This is a mess and all I can do is pray the GOD will let this all work out.
