So their GTech testings show, that the results were the same stock and when front wheel sensors unplugged (while car was off then turned on, and another time when car was still on). Hmmmm...interesting... just when I was maybe starting to believe the Mazda explanation, another hole in Mazda's story comes up.

Also if you want to believe that the 238hp number is true and the fact that it is the exact 5% limit from 250 is just a coincidence - it is ok.

Anyway, that is not how our system works.
You have to prove your case against them, with expert testimony.
The now invalidated dynos will not do it.
You need an expert, and guess what, you WILL NOT find one who will come close to what mazda will produce.
I have littigated against ford, gm, and mitsu. I have won, or settled at my clients request, all 0f these cases.
So I have some small experience in this regard. They have the funds and the resources.
Mazda in this case seems to have a vary plausable explianation to what happens with dynos.
the case would be bounced in a summary fashion, BEFORE it ever gets to a jury, as you will not be able to produce expert reports on this.
Even if you win, what them? You must prove DAMAGES! Mazda has offered to buy the car back, which is all they would have to do.
Only alternative would be a class action, BUT, these tend to settle for a lot less then individual cliams.
Oh yes, the last kicker: NO attorney will take this case on anything but an hourly billing basis. How does 125-400 per hour sound? How does 12,000 and up for expert reports and depositions sound? remember, in the U.S., the loser usually does not have to pay YOUR legal fees.
All in all, this is a dead topic. let it die, and we can all move on to discussing the pros and cons of a truly unique car!

An maybe you want me to post online the whole article before SCC? I can't because someone else (SCC) will post it. If you want to see the graphs and read about the test - buy that issue when it comes out or go to the library and read it.

Although the RX8 looks a lot more special and has the dynamic advantages of being RWD, better weight distribution, probably better braking and handling also. BUT most of the Evidence points to the RX8 being a 3000lb 215hp RWD 4 seat sports car. Just like the miata is a 135 hp 2 seater in reality.
