Need opinion on my rebuilt motor

I need your guy's opinion. I have a 2005 Automatic RX8 that I had the motor rebuilt by a professional Rotary shop in San Diego called "Jim's Rotary Shop". That shop is well known for its rebuilds and general service. Back in December of last year someone hit and totaled my car, the engine is fine. The motor was rebuilt in 2015 and right now has about 32,000 miles on it and still runs great.

The body shop I took it to held on to it for 45 days and never mentioned a storage fee, plus they didn't do anything with the car for 4 weeks until insurance asked them to tear it down for a quote. I want my car back so as to pull the motor and sell it to recoup some cost. The issue is the body shop wants $1800 in storage fees. I am not sure if the engine is worth much more than that, meaning if I pay his fee will I be able to sell the motor for much more. I have no idea what the market is for a good low miles motor. I paid $6,000.00 for the rebuild, which included two new housings and upgraded apex seals. TO be clear, this is a 05 manual 4 port motor. The miles are so low on my motor for being in the car for 7 years because I mostly drive my 06 Manual RX8.


Any advice anyone could give me would be appreciated.

Until the insurance company decides what they are going to do it is there dime.... so get them to deal with it.

Other option is a lawyer letter to get them to release the car as there was no contract to charge you storage fees up front.

They can't just decide to charge you after the fact


Of course thus is all off the table if you signed something legally binding about the fees
