Consult an attorney. Consultations are often free. Sometimes your employee benefits program offer no cost consultations as a benefit. This is a serious issue in both safety and dollars. You are a consumer, not a auto dealership, not a customizer, not a manufacturer, your granted certain expectations of performance which you are not required to request. I recently had my front windows tinted and signed my life away to document I fully knew what I was doing, thus transferring liability. Liability does NOT have time limitation in general. For the record, I am NOT an attorney but like police, they do occationally come in handy (better off you call them, LOL).

I have great news!!! I went in this morning and spoke with the GM. I took the picture of the frame you guys provided and explained the problem to him. I told him if Mazda would supply me with a letter stating the car is structually sound then I would take the car back and want a refund for the sunroof. He called Mazda. Mazda would not even consider giving me a letter. He hung up and said lets find you another car...... he REPLACED my car, not only did he replace my 2004 MT winning blue sports package, appearance package, rotary acces., and fender strakes. He replaced with a 2005 MT Winning Blue Touring package, and is adding ALL other acces. my other one had, including the leather!!!! And yes, no change in payments or conditions!! New car only has 13 miles on it!!!
What a relief, I was prepared for the worst, but he was great. I owe it all to you guys!!! Without your shared knowledge, I would have never know I was driving an unsafe vechicle, you guys may have saved my family's life!!

Mandy, that's great news. It's good to see that the dealer did the right thing. You can just imagine what Mazda must have told him. The potential liability was incredible.
Quite a few lessons learned on this one. I bet that this is one dealer that never again installs an aftermarket sunroof.

Wow, I can't believe how well that worked out for you. I'm glad you stuck to your guns. That dealer must have heard something awful from Mazda to change his tune so abruptly.
Now you've got to wonder what he's going to do with the messed up car. I imagine it's back on the lot for sale again, hoping nobody thinks it through like you did.

What a great ending to this story!!! I read each post, in order, like a really good mystery novel. By page 3, I wasn't sure I'd get to read the end result, and even if I did get to, I prepared for the worst news... But you came through, Mandy! This was a much better ending than "Million Dollar Baby"! And now you have the really cool retractable key, too. Congrats!

We just got home from signing the papers on my new, new car. I can't begin to tell you how great they were. They had all of the papers in order and ready to sign. I don't take delivery of the car until sometime next week. They have to put in the leather and etc. It will totally be worth the wait!
It was so nice that they completely stepped up to the plate and made an error right. My daughter will be 16 soon, when shes ready to get a car, you can bet we will be shopping there and recommended others to them. The whole thing could have so easily became a blood bath. I feel like I should sing God Bless America. LOL
When they handed me the keys for the test drive, I was like what the heck is this.... OMG It is way cool!!! :D

Congrats on your result. I love happy endings. I do have one concern however. In your first post you mentioned that the dealer installed aftermarket leather seats in your original car that you weren't happy with. This time around, I wouldn't take delivery of the car until you examine it very carefully to make sure EVERYTHING has been done properly and meets with your approval. Make the dealer correct everything before you drive off the lot. That being said, enjoy your new car and welcome to the club!

Fantastic results! Having to go through this ordeal sure was difficult but for myself I sure did learn alot. My RX8 is my favorite car and this web site has become my favorite site also. Have fun motoring!

i wonder what happens to the first car now? maybe Paul from Mazmart can pick it up as salvage and part it out.:D seriously i hope they dont sell it off to someone or other unsuspecting dealership. what was this dealership again?

Just to give you an update. I don't think they are selling it. When I went to pick up my new car, one of the salesman was driving it, actually he was learning how to drive stick with it. By far, not the easiest car to learn in, I told him if he learned with the RX8, most others cars would be a cake walk.
I know pretty much everyone there is aware of the problem with it, and don't see them dumping it on someone. Also, my new favorite person, one of the sales managers also just got a RX8 and is as excited as I am about mine.
I attached some pics of my car! I don't know what it is about these cars that make their owners completely crazy about them. I don't think I was as excited about my very first car as I am about my RX8. I still turn around after parking him, look back and smile :D

The Blue inserts are because you got aftermarket leather right? When I bought my first 8 it was a winning blue, but you couldn't get it with blue inserts....winning blue could only have black.

Yes, the inserts are aftermarket. I had the leather added to the first car, so the dealership added the leather to the replacement car.
BTW, I also learned they cannot take seats out of one car and put in another, because at first they were talking about taking the seats out of my old car and put in the new one. BUT... one of the service techs came out and talked to the GM and myself and explained that the airbags in the seats are coded, and if the codes didn't match then they may not work. He explained it as.... removing a light out of Christmas lights and then the whole strings doesn't work. So they of course left the seats in my old car and put new leather in the new one.
I thought it was interesting and appreciated the tech coming out to explain it. Would have never thought about that either, I could have been driving around with airbags that wouldn't go off, but atleast my cross member would have be intact! LOL Some one up there must like me :o that is all I can figure out!

Mandy which dealership did you go to? I went to the one in Carlsbad Hoehn and they were pretty cool there (at least the GM was, I felt the service guy was a lazy bastard). Glad you got the new car!

Congrats on a problem solved! I have a question for others on teh board though. The thing about the air bags dosent make sense (I admit I dont know alot about airbags) but if the airbags are coded to a car how do they replace them after you get into an accident and the car can be repaired?
