I Am An Rx8 Owner For About A Year Now.and 4 Months Ago I Had A Little Fender Bender.i Am Having Major Problems With The Bodyshop.my Car Has Been In The Bodyshop The Whole Time And Nothing Has Been Done.the Owner Of The Shop Continues To Ignore My Calls But Manages To Call The Insurance Company Claiming The Car Is Done So They Can Send Him The Check For The Repairs,meanwhile My Car Lays In A Cloud Of Dust And That Is My Only Car.what Are My Rights?

 

first of all, my eyes now hurt. call your claims office, give your claim number then ask to speak to the adjuster who is handling you claim. explain them the situation.

 

Here are your choices:
a) Tell your insurance company that it is NOT done and not to pay until it YOU tell them the car is done
b) Take your car to another, less shady, body shop
c) Kick the **** out of the body shop guy
d) If you are intimidated by the body shop employees, you can call the Sheriffs' Dept. to come with you as you take your car back

*Personally, I'd do them all in this order: A--> D--> B--> C

Call the insurance company and get your car OUT of there.
Simple isn't it.
Call the BBB and the Attorney General and tell them whats going on.
Oh and call the Insurance Commisioner also.
