This sucks dude. I had this same sort of problem with a scammer on eBay and payments via eCheck from Paypal.

Fortunately though you have an address for this guy, just take it to the precinct.

Gotta disagree with you here...this has ALREADY gone from bad to "worst case scenario". This guy isn't making any effort to pay you back and you've quite frankly; waited long enough!
The longer this drags out, the harder it will be to persue avenues which could get this part back for you.
-Police are going to be less and less willing to handle this after this many months.
- The longer you wait, the greater chances of this part never getting returned to you or WORSE, it could come back damaged by that time.

Not to mention that he has illegally replaced federal emissions equipment...I'm sure they could tack on that charge should they choose to...how much is that penalty?

Probably pretty steep in Kalifornistan.

The Police aren't going to help you. It isn't their call, you will have to take him to court. The police can't impound his car because they don't know if it has stolen properity on it or not. It's he-said she-said. Call the SF Bay area non-emergency police number and they will tell you the same thing.

You will have to file small claims paperwork with whatever county his address is in, and pay a company to serve him. Unfortunetly, it's doubtful any laywer will help you for a $200 claim, because they won't make any money off it (their fee is percentage based), or you will spend $400 suing him for $200, which is dumb. You will have to pay a processing fee to file papers, usually $25 bucks or less, and the court will serve him.

Then give him the option to settle outside of court, otherwise you will sue him for travel expenses to SF and other fees, and put a lien on his credit if you win, and you can choose to granish his wages or tax return.

And be smart and don't threaten physical viloence, or he can call the police on YOU for theats, which ever since 9/11, police are taking very seriously now. Some people on this forum might think it's "funny" or will scare him, but unfortanetly threating someone is a serious criminal offense

Hope you get this all settled, if you want anymore legal help, PM me.

O well, you got rid of a really awful member for $200, that's all he's worth to us here. Sorry you had to lose that money but if he's only worth that much there's no reason to linger around it for too long. You got his SN flagged and I hope the modderators will bad his IP from signing up again.

it's bad when someone does it once but you definitely don't go in and double dip and try to run the scam again. and to think he'd have the nerve to do it to shinka - it's on now.

I saw this kid at a dyno meet we had a few months ago. He didn't show **** about his car and I thought it a little strange considering all he had done to it. But this explains it all.

Mommy and Daddy pay for it all as long as he whines long enough.

Just a thought, but if the items are being shipped via USPS, they would be really interested in this. Postal inspectors don't play when it comes to using the USPS to defraud someone.
