Tire gets stuck on the inside of the fender when turning left.
The overall diameter of 255/40/18 and 255/35/19 are the same. But that does not mean a whole lot because tire manufactures do not adhere to a standard. Meaning tire company A and tire company B with the exact same size tire will not be the same size. One could be wider or narrower than the other.
It's hard to determine how bad it's rubbing without pictures. Tons of people run tires that are the same sidewall height as 245/40 without that problem. 245/35 would be significantly shorter for sure. If it is on par with Pdxhak, 245/40 should fix it. If you have it worse, then 255/35 should fix it. 245/35 just seems excessive to me. edit: Different height tires front to rear can cause problems with stability control or ABS or whatever. Not sure how much is necessary to cause the problem though.

I know it kinda sucks, but it wont truely be wasted money down the road since you'll have a spare set of rear tires already in the garage

Where did you buy your tires and how long have you had them? I believe Discount Tires has a 30 return policy if you do not like the tires. Check with your tire company to see if there is a similar policy.
Is there a Discount Tire by you? They will match internet prices. If not then call around and see if any of them will price match so that way you can get road hazard on your next set of tires.
Find prices online that are cheaper before you order because it will save you money. Also see if they still have the 30 day return policy that way if they are too big you can exchange them. 245/40 is .31" smaller per the one tire calculator I used. It would be a good idea for you to run the numbers yourself. Add in the difference between tire manufactures and you could end up with the same size or even bigger tire.

looking at it going from 255/40 to 245/40 will not change much. Now since my wheel is 8.5 wide and putting 245 on it would that stretch the tire and make it a lot shorter?
Stretch doesn't shorten a tire any appreciable amount. Also 245 on an 8.5 is not a stretch. Give me a second and I'll get a picture of my car at full lock in the front. 245/40 for me and it's pretty dang close.

Wow that is some major cutting. Different tire manufactures definitely have variations in their actual sizes. If you ran the same tire just at 245/40/18 instead, keep in mind that the .31" smaller tire means overall. That means 4 mm (.157") on each side. Judging by those pictures, I take it you may still rub.
Relating to 19s, because that is what I have the most experience with, I know people who run +30 offsets with 245/35/19 (toyos). They rub a bit when turning as well but nothing tire damaging like yours. I do not rub at all with the same tire and a +34 (fyi). A 245/40/18, not factoring in manufacturer differences, is 1 mm less over all. So .5 mm less than those setup I'd say is still rubbing, but no one has ever cut their tires from that.

ahh seeing that makes me say it's going to come down to manufacturer size variations. is your offset +30?
