Replacing tires in a set?

Replacing tires in a set?
This is my first post so bare with me.
I had an accident with my baby and had it taken to the dealer. After the insurance adjuster came and conferred with the dealer he told me that one tire was "bad" and that he would cover that one however the dealer and Mazda encourage replacing the tires in pairs on the 8 as it can damage the Limited Slip Diff and also play havoc with some of the "onboard sensors" if one tire is new and the other worn. The insurance man said that he could not cover the tire that was still good. So my question is would not replacing the tire simply make for a car that doesn't handle quite as well, some pulling and alignment issues would be expected? Or would not replacing the old tire actually damage the vehicle. Just as a heads up the car has 8300 miles on the tires and I had them diligently rotated at the recommended intervals.
I went ahead and had them replaced as a pair so the car doesn't pull but if I can get some facts in writing I'm gonna try to get the insurance company to foot the bill! If not I'd at least like to know if they were feeding my crap about hurting the car. I know that on an all wheel drive system it can damage it but for better or worse the 8 isn't awd.
Thanks for any help

I don't buy Kool-Aid
If you keep the old tire on the car and you dont replace it like I did. Your alinment will go out like it did on my 8.
Now I need new tires so I got some after market rims and tires but I still need a wheel alinment for a second time due to me not replacing the bad tire and the car ins co not replacing it like they should have.
