breaks squeaking -- under warranty?

i just bought a used rx8 (like 1.5 weeks ago) with only 4K some miles on it, and the brakes are already squeeking a little at some stops. is this still covered under warranty? should i go back to my dealer and complain?

also the headlight is flickering (not the main one, but the bluish one inside the main one), is that warranty covered, too?

thanks!

the previous owner could have put LED lights in there. i have them in mine to match my xenon's and one of the LED's flickers from time to time. they were a pain in the *** to install so that is the only reason i haven't changed them out yet...
