UK Thanks but help needed

I'd like to thank all the contributors to the "flooded engine" type threads. All the advice worked and we got her going again saving me atleast £200.
Well I'm looking for help and advice again. We have a 06 231 model Rx8 and the warranty expired in may this year. I have now noticed that the left hand rear shocker has failed and we have a oil leak from it. I have contacted Mazda UK and they asked for the vehicle to be inspected at my local dealer. That happened monday and the phone call came today saying they will not replace the parts as a good will gesture due to my servicing intervals. The car has a full service history and is due for the 37,500 mile service now. The issue is that the car did not have a "paid for" service in 2008 due to the car being serviced due to the Oil cooler pipes blowing off and being replaced under recall warranty.
I have now called Mazda UK to start a appeal against this to try to get them to do the work.
Has anyone experienced a shocker failing so soon, if so what happened and was it out of warranty. Also can anyone recommend a supplier for original parts cheaper than mazda or a good replacement for the originals..
