rx8 s2 issue with dealers. filled car with wrong transmission fluid so need advice.

i got 2009 s2 rx8. weirdly at my local dealers they had put service maintenance schedule as per mileage and not time ( in cases whichever comes first) so went to dealer to do a 47k service and told them that the car is currently 6 years of age and never replaced the manual transmission fluid. but they had said that the transmission does not need to be replaced until the mileage is 100k. i asked whether there is a time limit but they said there was just the mileage limit. checked the rx8 booklet and it says 60 000 km or 60 months. (whichever comes first) then comes the part i need advice. got the car manual transmission replaced then drove back home and few days later realised that gear 5 was grinding and it got worse and worse until one day it went. gear 5 was missing (unable to engage) and gear 6 once i engaged it then i was unable to engage the clutch. went back to agent with the car and found out that they had taken 4 litres of GL-5 fluid and put into both the diff and the transmission. i read on the forum that GL-5 mtf once temperature goes above 100 degrees will start eating away brass and other certain metals. where i am ambient temperature ranges from 33-40 degrees celsius so at times im sure it will definitely go above that. dealer is currently trying to put the blame on me so im looking for advice on what to do and that where i am there is only one authorised dealer to do repairs on the car. please help.

Be polite, but stand your ground. They put the wrong fluid in it. They own the problem.

You might look to see if you signed away any rights buried within a waiver of some sort.

If you cannot find satisfaction through the dealer, you can involve Mazda North America.

Thanks guys will try first advice first then if things go bad i guess gonna have to involve the lawyers. Really prefer not to but will see how it goes. At the dealers now.
