Hey guys... here's an update.

First off, sorry about missing that party, my GF came to visit and had *ahem* other plans to do with me that day. Something about working on my stick shift.

As for my vehicle situation here is what has gone down. I told the North Park Mazda to put in the new engine mount, although I didn't actually give a written signature. They did so and the engine vibrations were not affected by the new mounts. I specifically and on multiple times told them to keep my old mounts as well. So the dealership ended up tightening the PPF, fly wheel and a few other things that Mazda Corp required and it was deemed that the replacement engine was bad. This was my original suspicion and it turns out I was correct. So a new replacement engine was sent.

The second replacement arrived last week and the dealership finished installation on Saturday. I was given a call at 4pm and told it was ready. Sergio informed me that he, Jim the service manager, and all the techs on the car agree the vibrations I had before are no longer there. He informed me it was smooth now and that I could come by before 5pm and pick it up. I informed him I was out running errands and couldn't, but I did inquire about the mounts by asking if my old ones were replaced. He said, no they threw those away and that the new mounts are in. I asked if those are free of charge and he said no. I was a bit upset at this and informed him of this. He said to give Mazda Corp a call on Monday, which is today, and see if they'll cover it.

I just got off the phone and was told that since it was a mis-diagnostic performed by the dealership that they are responsible for the engine mounts. At this point I am wondering if I have a legal leg to stand on. No offense, but I don't have at the moment the extra $$$ right now just after the holidays.

My question is if anyone knows the answer, who is ultimately responsible for this? The dealership for mis-diagnosing the problem and throwing away my old mounts, Mazda Corp because the original replacement engine was bad and caused the mis-diagnotic in the first place, or me?

If it's not me, anyone know a lawyer I could call?

Oh and I've been recording phone conversations with mazda and the dealership now for evidence.

Well, since you brought them the new mounts it gonna be your word against theirs so really you are screwed unless they admit you told them to keep the old mounts. I would go in and talk to the service manager directly and explain that you did not need the new mounts so you should not be charged for the labor of installing them since it was not necessary.

Stand your ground, don't back down.

They have admitted a few times that I did ask for them to keep the old mounts, however I did not have that in writing and at the time I did not record that conversation. As of right now, I have set up my phone to record all conversations and will try to get Sergio to admit it again.
