Loose dead pedal

My dead pedal is loose at the base with only 2500 miles on the car. I tried to tighten the cap nuts that hold it down but these appear to either be cosmetic or already bottomed out. They do not turn. The lower nut doesn't hold the dead pedal down and it slips around.

I plan to take this issue up with the dealer on my next visit, but am I going to have to wait for them to order a part or will they be ablt to just fix it?

Haven't done it yet, I am planning a trip to the dealer later this week.

I took it to the dealer yesterday. They said that the carpet underneath had slipped out of place and the lower nut was crossthreaded. They took it out, replaced the nut, and put it back in and it is fine now. I hope it stays that way.
