I went in for an oil change (ya i don't change my oil) and some guy said it would take about and hour or so because of the oil change and some kinda of ecu (idk) update software. did anyone else get this? is this common?

Yep, that software update was issued a few weeks ago for all 2004-2008 RX-8s. Back in 04 there were software updates quite often, but it has been roughly two years since the last one. It's a no issue, have the update done for longevity if you didn't, it increases oil injection at startup and adjusts ignition timing under hot conditions.
