Another Transmission issue

Another Transmission issue
arite i've been on here quite sometime and looking around just have never post on here. i've been reading a lot on the transmission problems thinking it wouldnt happen to me. well not my luck. recently my car had grinding problems from 1st to 2nd like many of you guys on here, also my transmission started to clunk on me, so i brought it in with 17,000 miles approx and found out my clutch burned on me and told me the cause of my transmission is from the clutch. they told me it maybe from abuse and may not be covered under warrenty. i never drove hard on this car. i've bought this car used with 5,000 or so on it, and my build date is 9/03 which falls in the catagory of many fellow rx8members with the transmission issue. i would like to know if the people having these problems like to make a lawsuit with mazda. i am putting a lot of effort into this right now, so i would like to know who is with me at this point.

V3nom,
Sorry to hear about your 8s gearbox.
A trans noise and burnt out clutch are 2 separate issues.
I recall a post I mentioned earlier where a wealthy 22yo here in Oz purchased a new RX-7 turbo, within 5000Ks (thats 3000 miles) he burnt his clutch out.
From the smell of the plutch plate it was obvious abuse, he was earlier seen motoring like he was racing at Bathurst (thats a long distance car race here in OZ), he just thrashed the guts out of the car. Yes, his RX-7 is a sports car, but, he treated it like a racing car, which will shorten the life of parts. Mazda could install heavier duty clutch and pressure plates, but then you get complaints that shifting requires too much physical effort, its a balance.
Mazda Australia relaced his clutch free of charge.
.
With your 8 because you are the second owner, Mazda may be prepared to offer you a parts cost free and you pay the dealer the cost for labour.
The same may apply for your tranny.
What ever you do, don't threaten law suits.
Mazda Japan will be monitoring all RX-8 warranty claims, and if there is a manufacturing problem 9 times out of 10 they will have modified parts and with that extended warranty to ALL owners within vehicle VIN Numbers and build dates.
Sometime it takes time.
Good luck.

Here's one for you. I bought my 04 in April 05 w/175 miles on it. The first weekend I had it I took an easy little road trip to break her in. Within 15 min. on the road could not find 6th gear. WHen I got back I had a few of my car buddies try thinking I was loosing it. Nope, they couldn't find 6th either. Called the dealer and was told it's really tight to find but it's there. Took it back to them and said you drive it and tell me it isn't there! Guess what! The tech expert drove it and said "Wow your right!" I can't believe this. Hmmm. He called Mazda and to make a long story short there was a problem with the interlocks and connecting rods not being assembled right. Mazda said it was a fixable problem. I said no, it's either a brand new trans or a new car. You decide. After contacting the area rep and getting his okay I was given a new trans. So far so good. My dealer went to bat for me and I filed a complaint. I'm supposed to get an extended warranty of 6yr/75K but have yet to see the paper work from the rep.
