Got Rear Ended!!!!

So, I got rear ended by someone who could barely speak english. I was backing into a spot and they came flying down the street and completly ignored the stop sign and didnt even try to avoid me. I'm trying to see how much it will cost for me to pay out of pocket then go through insurance, especially since the cops are saying I am at fault. So I guess I will need:

Rear Bumper
Left Tail Light
Trunk/Spoiler? May be repairable
Left Exhaust Shroud?
Misc Interior Trunk Parts
Anything else you see in the pics.

The last pic is the *** holes car. Almost no ******* damage. The funny thing is they say they were stopped and I backed into them. Im stopped before the stop sign, they past the stop sign and hit me. What did I do? Reverse going 30mph and slam them? FML.

Tell your insurance what happened and that the cop is nut's. Then let them investigate the accident. I'm really not sure where you were and what you were trying to do so the whole thing is a little unclear to me.

I was trying to park at the corner where that stop sign is. So I would have been parallel to the stop sign. I came down the street to the right, turned right, saw no one behind me, proceded to back up, look up again to see an suv fly down the street beeping at me. I stop and bang. They yelled at me about the stop sign and I told them they are the ones that needed to stop. Especially since my car isnt even past were they should have been stopped in the first place.

talk to your insurance company immediately and tell them your side of the story. If you truly are not at fault, I am sure they can figure that out and get your car repaired.

That's what I'm afraid of. The cops were saying because I was backing up, it would almost always be my fault. I would rather pay $2000-$3000 out of pocket then $1100 more a year on insurance for who knows how long if insurance sides with them.

In Massachusetts rear end collisons are the fault of the person to the rear (even tho' we purport to have "no fault" insurance here), unless proven otherwise, so you're on solid ground. But do get with your insurance carrier asap and outline precisely what happened. Your insurance will go after his and again as the burden of proof is on him in this case you should prevail.

At least better than my recent hit & run (when I wasn't there) rear end, which thanks to my high deductable I had to pay out of pocket. At least it gave me an oppotunity to remove my bumper.

If you were backing up im pretty sure the blame will be on you. Yes he ran the stop sign but from your story it seems more like you backed up into his lane and he hit u correct?

Cost me better than $3k for way less than that. I basically just had a scratch on my back bumper from the kids license plate. You got metal damage there, going to need a lot of work.

There is no way you can do that kind of damage backing up into a stopped car.....

^+1 it shouldnt be your fault i had a similar situation in my last car but im in texas and cops said same thing it was my fault took it to insurance and they settled in my favor and got the ticket dismissed too that the dumb cop gave me

Dude, call your insurance company. You've got more than 2-3k in damage there.. if he did indeed hit you, make them fight and investigate for you. That's what they're getting paid for.

According to insurance, the way mass state law is written, if you are backing up it is always your fault. They said I could fight it and with the pic sI have a may be able to win but they weren't to positive I would win although you can see that they had to at least partially pass the stop sign to hit me. I even asked why they were driving where parked cars should be. idk, gives me a reason to buy a body kit though. Just need to see what underlying damage there is.

But I thought you were stopped when hit (in the act of backing up, but stopped).

I think any reasonable claims adjuster/attorney would have to side with you given the extensive damage - no way simply backing into a (stopped) vehicle would produce that much damage.

Technically, by mass state law, if you are in the act of backing up it is your responsability and you are at fault. I was stopped when I was hit, but still in the act of reversing. Their story is I backed up and slammed into them(my fault) and my story is they passed the stop sign and hit me(their fault). Only difference is I have pictures in favor to my side but nothing conclusive. If I go through insurance and lose, I will be spending $1k-$2k more a year on insurance for x amount of years. To me, it almost seems easier to pay out of pocket. My decision will be based on what underlying damage there is. If its all cosmetic(new bumper, trunk etc + paint) I will do it out of pocket since it gives me a reason to buy a new bumper. If there is significant damage underneat the brutality, I will go through insurance.

Rear bumpers are easy and relatively inexpensive to replace out of pocket ($625 painted in my case, including also one exhaust surround; no lighting issues; self-installed), but you appear to have trunk structural damage.

Your picture clearly shows you were in the parking lane, not a travel lane.

Any insurance company will mostly rely on what the Police Report states....I suggest you review what the cop wrote on the accident report. This will determine how to get your story straight before going thru your insurance...

DO NOT TOUCH, REPAIR OR MODIFY YOUR CAR UNTIL THE INSURANCE COMPANY VIEWS IT otherwise you will slow the process and eventually end up having them against you...TRUST ME I've been thru this many of times following the rules of those who exactly know how to win a case against many INSURANCE COMPANIES..

I know it sucks having your car like that, but I STRONGLY SUGGEST don't do anything until you have a BODY SHOP estimate ( Make Sure it's HIGH ) then insurance takes pictures, and a full declaration of your story etc etc....

BTW you can buy parts, but don't tell the insurance you allready found the parts otherwise they will revoke your claim...
