Angry What Should I Do? Give It Back Or Keep It!

I recieved my RX8 the end of January 2004 and about half hour after pick up the engine light came ON! took it back the next day they ran some tests got it back same day. The next day Engine Light came ON again took it back and they said I need a new CAT and O2 Sensor. I also have moisture in all of the exterior lights (Front Head Lights and Rear Tail Lights) and my brakes were screeching and the shifting in third and fourth gear were rough.
My RX8 has been at the dealer for the past 3 weeks waiting on parts form japan to come in.

What Should I Do?

Should I give it back and cancel the sale and ask for a new one or just bear with it and hope for the best.

Get a new car, that just sounds like a lemon! I have had my 8 since December 14 and have had no problems with any of the parts you have described. A lot of people have had them much longer than I and have not had those problems. If it is having trouble straight out of the showroom, just imagine what it will be like at 50k. The parts that you have can still be used on the new car so you would not be loosing anything. You may also want to see what the lemon laws in your state are. It could save your neck in case the dealership wants to screw with you.

Unless your car meets the prerequisites of your states' lemon law I don't think you have a choice....You bought it, it's yours.

I agree with Texas 8 - you bought it, you own it, it's not up to you to decide to "give it back and cancel the sale" nor "ask for a new one". If you had a very cooperative dealer, they might be able to work a deal to buy it back, but it's doubtful. The car is yours, not theirs, legally.

Their obligation is to fix it under warranty procedure, not buy it back from you or cancel the sale. The lemon law is an entirely different animal and if you meet those requirments then you can have them take it back.

But isn't it under the Lemon law that after 30 days from initial purchase if you still haven't driven the car, and they are still trying to fix it, they owe you refund or exchange?

Your pretty close to the lemon law time period. I think in some states its 30 business days. I kind of hope they don't fix it so you get a new one.

Just check the lemon law in your state... Under California laws, it's your's once it leaves the lot... sooo...

Sounds like the TdotRx8GT has not had 'his' car one week total time off the dealer's lot.

If I was him - I would talk to the dealer (the owner not a employee) and ask what they can do for him - if they say "Go blow" I would talk to a lawyer and at least have the lawyer write the dealer and Mazda USA and detail the situation. Make some noise.

Just because you took ownership of it does not mean it is your problem. You bought a new car, and it should be everthing that was advertised of it. The problems you are having are not typical, and at the minimum should be rectified to your absolute satisfaction.

I would be making lots of noise. That is an unnaceptable situation. I would be demanding an equivalent RX-8 to drive while they have your car. 3 weeks!

An easy way to get what you want. I heard about somone doing this a long time ago, and it worked. Take a big ad in a local paper. advertise a brand new rx8 for 10,000, but state clearly the catch that is doesn't work and that the dealer cant seem to fix it correctly. (maybe advertise it for parts) State that its available for viewing the the dealers (name them) shop. Keep running the ad. I bet that you will get a call from Mazda corperate and/or the dealer stating that they will do whatever you want, just stop running that ad!!!

That's not true my mom had a volvo S80 T6, it kept breaking down on her week after week, took it into Neftin Volvo 3 time, a long time after we bought it (we bought it at a totally different dealer about 3 hours away), apparently we found out a whole new prob with the car. Anyway is was more than a few months after we bought it and they gave us a new one under the California Lemon Law...still have the new one.
