NY Pulled Over for Speed Not Reasonable And Prudent! Need Advice

Befor we get to the story i have two priors 75 in a 55 and failure to yield for an emergency veh..... 6 or 7 points on my license currenly

Okay so last night i was driving my girlfriend home on wantah avenue( i live on longisland around massapeqa) i was driving around 55 in a 40. Im almost at my gfs house and a car that was speeding down the block pulls me over right in front of her house. Officer picota or w.e. tell me to get out of the car! I comply! Where r u from? he says.. so i tell him, he says where r u going? I tell him the house in front of us is my gfs house and im dropping her off. He starts yelling ( no exageration) that u could of killed someone, that the girl next to me coulda been killed. This in mind i wasnt driving like an *** switching lanes... but i did make a quick turn onto her block bc rx8s are nice for that stuff, in no way was the turn violent, dangerous, or tires screeching. The officer continues .. of course i cant get one word in to explain myself.. He goes up to my gfs house and tells her mother that i was driving like a maniac and that i coulda killed her... i still cant get a word in.. He goes on.. I was sitting by the gas station a few block back and do you know how long it took me to catch u? The look on his face said dont respond, he also added that he almost got into an accident himself trying to follow me (i guessed at the turn on to her block which he was nowhere near me) .........I finnally saw headlights when i was halfway down his block so he prob got a glimpse of me by the gas station and pulled out to see just where i turned... Took my license, took my insurance wrote me a ticket for Speed not reasonable and prudent with an attched copy of the supporting deposition which he wrote down i was doing 70 in a 40 .... i dnt need to lie on a forum but i was not goin 70.... more like 50-55.....

Question? with the priors can i fight this because i dont want points and the speed wasnt verified by lazer or radar... and what should i do in general

go to the court, bring your gf too. ask him to show evidence of you doing 70. he probably pissed cuz he tried so hard to catch you, so he slammed you a big ticket.

You were an ******* for going too fast in the first place.
Accept that, it was your fault.
Now the cop's behavior was completely inadequate, i would fight that over the speeding ticket. You have witnesses (gf and her mother) that he started offending you for a driving code infringement he possibly can't prove.
After that, if he really has no proof about you doing 70... he's screwed twice.

That's how it'd go here at least, dunno about your state

Reasonable and prudent sounds like a catch all like Careless/Reckless Driving. He didn't clock you with radar and couldn't pace you so he thinks you were going a certain speed but can't prove it. If you believe you are right, lawyer up. His tirade to your gf's rents could be considered slander
You failed to mention how your gf feels about your driving.

my first question is: how sure are you that he didn't clock your speed?
I was pulled over once for speeding and called him out on it thinking he was being a jag...but he proceeded to show the digital display and sure enough......

I would definitely ask for a court date and take the gf. if he doesn't show up it might get dismissed.
and if he has no proof, then wtf kind of **** **** is that?!

also forgot to comment on all these "flames".

everybody with an 8 takes corners a little faster...it helps us forgive/forget about the low torque.

Definitely go to court for this and take your gf with you, maybe even her mom if she saw the whole thing. What I have done a few times, is to write a personal letter to the judge of the courthouse in w/e city I got pulled over and explain everything to him. Every time, I've gotten off with a fine but no points. Your cop definitely sounds like a jerk. I know it's very easy to go 10 mph over the limit, especially in the Rx8, but you really do have to be careful, especially in residential areas because you never know when a kid could walk out onto the street.

I dont know how fast you were going since i wasnt there but i do know its the end of the month in NY and they are on a blitz. I saw at least 6 officers on the road today and at least 4 cars pulled over randomly you could have been going just fast enough for them to have an excuse to slam you most likely they would reduce it to a fine if you fight it because then the tickets support the local municipality rather then the State and the local judges would rather it that way.

Two speeding convictions, plus failure to yield to an emergency vehicle, already on your record. You admit you were going 15 over when you got pulled over. The cop took a dislike to you...not necessarily an unreasonable attitude toward someone speeding in a residential neighborhood.

You need a lawyer, not random advice on a forum.

The cop was just mad because he couldn't catch you very easy.

It's always hard to catch up to any car, especially one like the 8 that doesn't waste speed on a corner.

To us, the 8 drives normal, but to others it looks like it's doing super car stuff.

Just get a lawyer, and subpeona your gf and family.

If he has the choice, he may not want to have his unprofessional attitude on the record.

Thanks for the advice! Id like to clarify, I am not a reckless driver, he saw me on a main road off residential streets... i dnt speed on side streets bc many people walk thier dogs at night and i am aware of them which is where he caught me lol.. o and as far as the lawyer goes.. they r very expensive so if i have a very good chance of fighting it without one it would be +1

Since your driving record isn't all that great, you should get a lawyer and not risk another penalty. If you really don't want to get a lawyer, that's a gamble you're gonna have to decide on. I would think that if the officer doesn't have proof of your speed, you might have a chance to get off with a reduced charge, but you never know.

Soo true. The people that guve u the deals never rele give u a deal... if they would hit me with just the fines without the points i would be good with that

fight that **** man! most of the time when you plead not guilty they set a court date for like month later and the officer doesn't show up, which means you walk. dont take that **** lying down cause the donut muncher couldn't keep up with a badass ride!

Here in Texas you can take a drivers ed class for about 8 hrs, and $50 approx. (I haven't neede it for about 10 years) which allows the ticket to not go on record, but you pay fine anyway.

That can be done once a year.

Just talk to the judge or court (at this level they're somewhat informal), ask for court date, and describe the officers attitude, and no evidence.

Maybe that loose cannon will back off to minmize damage to his reputation, and he's probably acted unprofesional before.

See, everyone can do legal things; the cop is unperfect just like regular perps, just gotta find out where the goat is tied.
