oh, really **** with them and go pick up some business cards... just be as simple as that, if they ask why. just tell them its for you to drop off with your lawyer for contact information regarding your warranty denial they can't provide in writing. just be nice about it and walk out the door....

this is when it gets fun, They'll either call your bluff, thinking you haven't lined up a lawyer (at this time you should already have gotten a lawyer that is interested in atleast reviewing your case) and let you walk away.

or B) you will have somebody flagging you down before you roll off the lot realizing they're about to have to get their own attorney and additional paperwork to file once you've started the "Legal Process". And at this point, since they refuse to giving you any written 'statement of warranty denial'. It's literally a fields day for your attorney.

Best outcome.

They fold on (B) when your attorney starts the contact process to collect statements, and settle... if it really goes this far, and they decide we'll honor your warranty. MAKE SURE THEY HANDLE ALL LEGAL FEE's and related taxes, you shouldn't have any contact with them at this point, and all communication typically goes thru your attorney...

That said - have fun! .... no i'm now a lawyer.. and the above is not legal advice you can take to court but politics has always been an interest of mine, and excercise daily with a Wife & 2 kids

later!

Mike

They have to prove that the engine failier was directly attributed to the intake. Find out exactly what happened to your engine, ill tell you if it was intake related. If theve replaced any engines with the stock intake and same problem your gold, think about it. Take that to court.

^+1 and think of all the guys that are in SoCal NV AZ UT CO TX and all them other states where we get tons of dust and winds that have the K&N T II and drop in filter that have never had there warrenty voided or better yet it stated in there paper work from the dealer in black and white for a court of law that the engine has failed due to excessive debri due to a after market intake and or modification on the vehicle that work was performed by the dealership.
Tell them to suck that one down!

that is kinda wierd... If he blesses the water coolant.. will it stay cooler?

Seriously though, get the mazsport water pump installed while it's out... if you do go turbo i believe another seller here that has a fuel pump upgrade that can handle the boost so you don't blow up the rebuild...

What kind of service are you talking about? A routine oil change doesn't count. Just a matter of time for you.

To the OP: At least some good is coming out of this. You may still want to weigh out your options to see if you can do something about that dealer

Hopefully when you say "After I get the turbo" you mean, "After I receive it, but before it's installed"...as without the supporting mods, you have a chance at blowing the motor...then that's on your shoulders, and not much help can come I'd hate to see that happen!

Why the intakes anyway? They're useless, they give you a temporary 4hp if you're lucky, for...around $300 dollars? Man, talk about more bang for your buck!

But congratulations on your new engine, treat it good and GET the supporting modifications! lol, go do a burnout in the service bay of those dicks at the dealership who gave you the shaft

intakes a musttt.. even though you wont gain much horsepower from it but its for better breathing air then cluttered air box with warm heat.

How is it better if you get no horsepower gain? If the stock box was feeding insufficent air to your engine then you would see an obvious gain after installing your CAI.... So you void your warranty or risk getting crap over it if you need warranty work for absolutely NOTHING.

Sounds like staying stock would be the smarter move.

I wouldn't be so happy if I was you, you've just been hosed out of a new engine under warranty and you are doing nothing about it.

Now that you have the engine replaced take them to small claims court here are limits by state.

http://www.nolo.com/article.cfm/obje...4/308/273/ART/

**** with them, sue everyone involved in small claims, get the mechanic, service manager, owner, regional manager and Mazda. Hit them for the full $7,800 they said it would cost you. You don't need a lawyer to do this and worst case you won't collect any money from the individuals but will cause them a lot of grief and lose of work.

You will collect off of Mazda because you are in the right and they have proven nothing. Get your ducks in a row, have you buddy write up a statement that the MAF was fine and no leaks in the intake were detected. Bring in a time line of what happened showing each time Mazda refused to document why the warranty was refused.

Do not roll over on this, you were screwed out of something you paid for. You don't need a lawyer for small claims so file and give them the same headaches they gave you.

Just get a K&N Filter for the better breathing. Not spending $300+ for something that gets you nothing

Well obviously theres a better volume of air and better vortex of air going to your motor, even if i dont get much horse power out of it, im not complaining since i know what i bought and i know what ill get from it, and also knowing the lack of power it does. its a simple mod that got my *** in some shyt but i aint regreting shyt and im definitley not complaining about the intake. its all about prefrence dude..And also its not insuffecient air... only when your cars running LEAN..lol.

Why would you be running lean? Is this common in the rx8?

noo i am not saying that my car runs lean, but meaning by if you run lean then it means ur lacking air and fuel.. more air and less fuel=lean if you are not in STOCIOMETRY... but more fuel less air=running rich since there is more fuel burning with less air to compensate the amount of fuel.

If you are not gaining anything with the CAI what does it matter? You have sufficient air for the motor as designed by Mazda. Now if you where using FI aftermarket CAI would be good I think? I don't know? Not really a hot rodder myself I prefer things stock. If I want to go faster I buy something that is faster.

I'm not knocking any of you guys that whent FI, more power to you ( no pun intended )
