Aside from that, the police report is an absolute travesty. It is completely the opposite of what I have been told by my wife and a witness noted on the police report. They had my wife going 40mph, when she was stationary or maybe doing 1-2mph. The other vehicle is stated as traveling at 10mph and impacting the side.

Luckily, my witness has also stated the accident happened pretty much as I am digging up evidence to prove.
well, the pictures that i posted indicate situations in which the airbags might not deploy...pretty much exactly the angles that the car was hit from. also, for the frontal airbags to deploy on even a head-on collision, according to the manual, the speed has to be in excess of 12mph.

xeony2k, this might be a case where the "black box" capabilities might play in your favor. If your wife was really doing only 1-2 mph then you might want to get the stored ecu data analyzed. Not sure if the accelerometer's readings are held when the bags don't deploy but it would probably be worth a look.

Haven't gone very far with getting the car repaired. Got it to a body shop that I hope can repair it to my satisfaction. I also got the appraisal from the insurance company... $5400 and some change. Seems a bit low and they missed a few obvious items. They missed the drivers seat altogether, the base part of the seat is broken. The body shop is doing a tear down, so that should be a little more accurate IMO.

Well....... (drum roll please)

I picked up the RX-8 today. $18,741.33 in damage is the number the car is at now.

It still needs to have the rear bumper fixed (replaced?) and repainted.... so the number will go up at least with that if I do not find anything else. Somewhere along the way the bumper took a pretty good hit in the center (indentation) with a few deep gouges on the right side of the bumper.

The appraiser did not want to include it in the job and the body shop did not tell me the appraiser had come to this conclusion. I did not know this until I went to final inspect with the shop manager last Friday evening.

A call to my insurance company was all it took to explain that my bumper got busted up sometime after the accident... and they told me to have it fixed. It was a PITA that I had to deal with three separate entities; a shop, appraisal firm and insurance company. Actually the true PITAs were the incompetents at the appraisal firm. I think I went through three agents... or people leaving is an excuse they use for them dropping the ball.

Will post pics when I take some.... but it looks pretty good. I need to invite some friends over to look it over. My wife is glad to have it back.

first off... glad your wife is fine

But to the car: I hope it drives right, I've seen cars totalled for less damage than that. And selling it is going to be a pain in the *** if whoever buys it or takes it in for trade does a carfax report, it's going to drop your price astronomically.

but it's fixed and running so best of luck to you

Wow looks like my RX-8 when I got hit by some a$$ taxi. But my head ligths did not bust and my fender was not as bad. Hood was bent front grill was cracked wheel was all scratched up that was about it. Best of luck to ya man. It hurts to see an 8 in this kind of shape.

That car should be totalled. And you need to get a lawyer involved to get the police report straightened out. With a witness who's willing to testify it shouldn't be too difficult. If you don't get that fixed your insurance is going to go through the roof.

i would never let no body eat or bring anytype of food related items or liquids to my car. the only liquid i accept is water with the condition of not leavin the bottle on the car or you loose the privileges.
thats the first rule of RX8 club
2nd rule, no body but the owner shall sit on the driver side except on certain cituations where driver might be too drunk to drive. and even then it has to be confirmed by 3 witnesses.
3. No girl/woman shall touch the stick, unless specified by driver or by gratuity from the female in the act.
4.Ya shall not use the RX8 name in Vain. No Honda or Nissan or any other owner of a riced up vehicle shall use the cars name.
5.No more than 2 people allowed in the car unless the other 2 are good lookin girls. or 2 good lookin and one UBF.

They fixed my 8 after $25K of repairs But she runs like nothing ever happen to her.
