Gilbert you are on the right track. take it to court. your receipts and notes on the dates etc are all you need.

Did the OP ever mention the type of failure (Other than "Blown up")? This would be interesting to know. Does it start, does it run poorly, is it smoking, is it seized, is it lacking power, does it shut off at idle speed?
