So the Bank screwed up.

So i purchased my car through a private party and financed my car. The day of the paper signing I called my financing rep and they spoke with the bank, scheduled a time and sent in the paper work. When i showed up at the bank with the previous owner they were so unorganized, they acted as if they didnt know I was coming nor did they have the paperwork prepared. They turned maybe an 1hr visit if that into about 2 and a half hours of waiting. We signed all the paperwork they were like ok thank you and walked away, the previous owner and I were like are these people serious we had to go back to the manager and ask forthe new owners check in the amount of the finance as well as as copy of the paperwork. Usually there is a fee for the paperwork (tax and titling) I even reminded the person who did my financing about it trying to be honest they said "oh ok yeah thats right" long story short it never happened so I said screw it I waited long enough ill keep my money and ended up paying the DMV the tax providing them with all the title information and what not. Two weeks later I received the title in the mail...........no lien on the title. So about a month ago the bank sent me a paper regarding not having a lien recorded on my title and they want me to send the original title in so they can have it titled with the lien so im taking my sweet time. I have been paying my monthly payments but im in no rush to send them the papers. I have a clean title in hand I have wondered what this would mean because it basically looks like I own the car free and clear.

Is the title from the original owner? If it is you gotta sign it and send it back in so it can be transferred into your name, and then the bank holds it. I think that's the way it works anyways.

edit: maybe you already did this...I don't know...your post confuses me with the lack of punctuation and paragraphs. Not trying to pick on you.

The title is a brand new title not from the original owner one issued by NYS with no lien information recorded and with my name as the owner free and clear they want me to send in the paperwork so they can title the car with their information and put the lien on it, mind you all this information was provided to them I have copies as well as provided to the DMV upon getting my plates and what not.

see if the previous owner got his money already.

u have to tell ur insurance if u're financing. so in the end u probably have to add them to ur title.

see what happens.

Best answer would be to call a lawyer and ask.

Or maybe an accountant, I don't know.

The previous owner received a check that day definitely got his money. My insurance has all the information I had to provide all of that information during the financing process they wont even let you finance the car without proof of insurance this all happened about 2-3 months ago.

I'm not sure what you are trying to accomplish here......you still have to make the payments...so why not just have them add the lien to the title like it's supposed to have?

I'm not trying to accomplish anything specific besides obtaining information I was just curious if anyone has been in the situation before I still have and will continue to make payments, they receive them and obviously I owe them there us a rather large paper trail. I was curious about why the recording of the lien on the title is such a big deal is it because they technically i can sell it as a clean title and the person buying the car will not know. I will be sending it in I was just curious as it is the banks error and wanted to see what people had to say If liens are all recorded with banks and come up via vin I just dont see why the lien has to be even on a title thats all. Thanks
