CT Improper Exhaust in CT!

Yesterday as I was coming home from my friend's house I get pulled over on main street by a cop. I wasn't speeding and wasn't breaking any traffic laws. when he comes up to my window he asks for my license and registration, goes to his car. then comes back and says that i have an Improper exhaust and said that I can't add anything to the exhaust to make it different from stock. the ticket he gave me was for $225. I wasn't even in the high r evs so he couldn't possibly say that it was too loud. I have the agency power exhaust on. He said that the muffler was illegal to put on, anything different from stock was. I see cars everyday in danbury with different exhausts on and here this guy tells me that mine is illegal.

Can you guys give me some advice on what I should do. I live in Danbury, CT

I think that's just a dick cop to tel you the truth, you are catless aren't you? But I couldn't see how he could find that out without actually looking under your car

the cop is full of it. if you are catless then you could get a ticket for that but saying that you can't put a different exhaust other than stock is false:

Sec. 14-80. Mechanical equipment. (a) Each motor vehicle and the devices on such vehicle shall be operated, equipped, constructed and adjusted to prevent unnecessary or unusual noise.



(b) Each motor vehicle operated by an internal combustion engine shall be equipped, except as hereinafter provided, with a muffler or mufflers designed to prevent excessive, unusual or unnecessary exhaust noise. The muffler or mufflers shall be maintained by the owner in good working order and shall be in use whenever the motor vehicle is operated. No person, including a motor vehicle dealer or repairer or a motorcycle dealer, shall install, and no person shall use, on a motor vehicle, a muffler or mufflers lacking interior baffle plates or other effective muffling devices, a gutted muffler, a muffler cutout or a straight exhaust except when the motor vehicle is operated in a race, contest or demonstration of speed or skill as a public exhibition pursuant to subsection (a) of section 14-164a, or any mechanical device which will amplify the noise emitted by the vehicle. No person, including a motor vehicle dealer or repairer or a motorcycle dealer, shall remove all or part of any muffler on a motor vehicle except to repair or replace the muffler or part for the more effective prevention of noise. No person shall use on the exhaust system or tail pipe of a motor vehicle any extension or device which will cause excessive or unusual noise.



(c) The engine of every motor vehicle shall be equipped and adjusted to prevent excessive fumes or exhaust smoke.



(d) All pipes carrying exhaust gases from the motor shall be constructed of, and maintained with, leak-proof metal. Exhaust pipes shall be directed from the muffler or mufflers toward the rear of the vehicle and shall be approximately parallel with the longitudinal axis of the vehicle and approximately parallel to the surface of the roadway, or shall be directed from the muffler upward to a location above the cab or body of the vehicle so that fumes, gases and smoke are directed away from the occupants of the vehicle. Exhaust pipes on a passenger vehicle shall extend to the extreme rear end of the vehicle's body, not including the bumper and its attachments to the body, or shall be attached to the vehicle in such a way that the exhaust pipes direct the exhaust gases to either side of the vehicle ensuring that fresh ambient air is located under the vehicle at all times. The Commissioner of Motor Vehicles may adopt regulations in accordance with the provisions of chapter 54 to establish safety standards for passenger vehicles equipped with exhaust pipes located in front of the rear axle.



(e) Every motor vehicle shall, when operated on a highway, be equipped with a horn in good working order and capable of emitting sound audible under normal conditions from a distance of not less than two hundred feet, but no horn or other warning device shall emit an unreasonably loud or harsh sound or a whistle.



(f) No vehicle shall be equipped with, nor shall any person use on a vehicle, any siren, whistle or bell as a warning signal device, except as otherwise permitted by this section. Any motor vehicle may be equipped with a theft alarm signal device which is so arranged that it cannot be used by the driver as an ordinary warning signal. Any authorized emergency vehicle may be equipped with a siren, whistle or bell, capable of emitting sound audible under normal conditions from a distance of not less than five hundred feet and of a type approved by the Department of Motor Vehicles. Such signal shall not be used unless the vehicle is operated in response to an emergency call or in the immediate pursuit of an actual or suspected violator of the law, in which event the driver of the vehicle shall sound the signal when reasonably necessary to warn pedestrians and other drivers of the approach of the vehicle.



(g) Any person who violates any provision of this section shall be fined one hundred fifty dollars for each offense.

oh, one other thing. if you do decide to fight it, definitely make sure that midpipe is legal and if not, swap it out to be inspected. if they are saying it is the exhaust you can be sure they'll amend that to check out the midpipe to get you on something.

EDIT: just saw that you have the AP DR mid-pipe so you really do deserve the ticket. that being said, i would still fight it and just put on a stocker with the cat and see what they say.

I do have the DR midpipe on but he didn't look under the car so he couldn't have known. and thanks for the advice guys

yep. i'd put a stock cat in there. take some pictures to bring to court. point out that it is a catback and that it is entirely legal. you have not touched emissions. you were not going fast, so dB were not an issue, etc.

i'd definitely fight it.

Yeah that catback is 50 state legal as long as you don't put in the mid pipe. Swap and fight.

is there a site that i can go to that says that the exhaust is 50 state street legal. Agency power doesn't say it on their site next to the product, they just describe it. some sites say its for off road use only. I think thats because it shows the midpipe in their picture. I need one saying its street legal so that I can print it out and bring it to court. If there's no site I'm going to give agency power a call after this holiday weekend so they can send me an email or something

Your cat back is not illegal, but your mid and downpipe are. Heck, it's actually emission tempering, they can definitely screw you for more than $229 bucks.

I live in Danbury and talked to a cop here. He said that some cops in the area are just ticketing people with loud exhausts to cut down on noise and street racing, which is total bullshit. I would put the cat back on and go have it emissions tested, then when it passes you can bring that to court to prove the legality of the exhaust. Also you may want to call the police department to see if they have a decibel limit on exhausts. Sounds like the cop was being an ******* to me.

I had gotten a 225 dollar ticket for loud exhaust on my 92 prelude two years ago. I had after market system from the header to the muffler. It was loud when I would step on it. But the cop didnt pull me over until I went under an underpass. So of course it was going to be louder under there. Anyway I had gotten pulled over in Waterford CT. When the cop had pulled me over he didnt test the system do see how many db's it was. So i did have it test a week after and it was way over. So what i did was sent the ticket back as not quilty and I also sent in a letter explane what had happend and that when i was pulled over the officer didnt it test it, he really had no way of telling how loude it was.

If the cop that pulled you over had not tested the db's then i would put the stock cat back on and have it tested to see if it is legal. I had my system test in Withersfield CT. I think you should fight it. Also I think when an exhaust system is said to be 50 states legal that means that it is smog legal? But i might be wrong.

yea it probably is smog legal but not wit the midpipe lol. i am fighting the ticket. currently the ticket has been transfered to the court in danbury which does this kinda stuff, but they still haven't given me a date to come in. cop didn't test anything.

i forgot to mention this before but my friend drove along the same road about 5 minutes before me with his mazdaspeed3 which has a turboxs turbo back exhaust with the turboxs single res downpipe and racepipe on it. cop didnt pull him over but pulled me over. really? wtf

Or the cop just noticed how bad the car smells, probably knew you removed the cat.

Most gear heads can smell if a cat isnt installed

Hey guys my ticket finally got resolved today in court. I won! I got up to the woman who was doing the traffic tickets explained what happened that night and then showed her pics of the exhaust i had on minus the midpipe of course lol she then asked if i still had it on the car and i said no and have sold it already. she then signed off on my papers and said i didn't have to pay a thing and i was on my way. i walked outta that courthouse with a smile on my face being that it was the first ticket i've fought.

Anyways thanks for all the help guys

When she asked you if you still had it on, did she mean the AP Exhaust? (I'm guessing it's just that since u took off the midpipe and put your CAT back on)

yea she asked if i still had the exhaust on. the cop didnt mention anything in the ticket about my midpipe. i didn't c him attempt to look under the car to check if my cat was there or not but it was at night and even stock the rx8 sits low. i took off my whole setup and put all the stock stuff back on. only aftermarket thing i have on now is my aem intake. btw i don't hate cops in general i just hate the few ******** that give cops a bad image and that like pulling people over just to **** with them.
