Illegal left turn in Union Township, NJ

Angry Illegal left turn in Union Township, NJ

Anyone pulled over for this? I got a ticket for this during my lunch hour, the officer didn't list a statue number only, "no left turn in Union Center." No sign was posted, so I probably will end up fighting it with some photographs I'll take tomorrow or sometime later this week.

When I called the municpal court, they didn't have an answer for me because there was no statute number listed, and mentioned that it would be sent back or dropped entirely because of this.

I know it's 3 points based on 10 seconds of research I did... but have no idea how much the fine is.

Great... just finnished paying off my car, and the insurance is probably going to skyrocket...

i dunno but in my town, wayne, there's practically no legal left turns on any main roads (even places where a left turn is obvious and easy, its illegal). Union Center sounds like maybe the middle of town or something so maybe there's no left turns there. There does HAVE to be a sign showing no left turn.

fight it! no signe, to tickie. state statutes are constantly changing. if it's totally illegal to turn, there should be signs posted at that intersection.

Just because an officer leaves a box blank does not mean it is grounds for dismissal. He did write the offense in the box, just not the statute.

The only way you can really fight that ticket is if there is no signs that are posted at the turn or in the area. But make sure that there are no signs in the area that say no left turn. Also there might be a township statute that covers that no left turn. I know your pissed off but do your research before you go to court.

Below is the statute for improper right and left turns....

NJSA 39:4-123
39:4-123. Right and left hand turns
Except as otherwise provided in this article, the driver of a vehicle intending to turn at an intersection shall do so as follows:

(a) Right turns. Both the approach for a right turn and a right turn shall be made as close as practicable to the right-hand curb or edge of the roadway.

(b) Left turns on two-way roadways. At any intersection where traffic is permitted to move in both directions on each roadway entering the intersection, an approach for a left turn shall be made in that portion of the right half of the roadway nearest the center line thereof and by passing to the right of such center line where it enters the intersection and after entering the intersection the left turn shall be made so as to leave the intersection to the right of the center line of the roadway being entered. Whenever practicable the left turn shall be made in that portion of the intersection to the left of the center of the intersection.

(c) Left turns on other than two-way roadways. At any intersection where traffic is restricted to one direction on one or more of the roadways, the driver of a vehicle intending to turn left at any such intersection shall approach the intersection in the extreme left-hand lane lawfully available to traffic moving in the direction of travel of such vehicle and after entering the intersection the left turn shall be made so as to leave the intersection, as nearly as practicable, in the left-hand lane lawfully available to traffic moving in such direction upon the roadway being entered.

The State Highway Commissioner and local authorities, for highways under
their respective jurisdictions, may modify the method of turning at intersections by
clearly indicating by buttons, markers or other direction signs, within an intersection, the
course to be followed by vehicles turning there. No driver shall fail to turn in the manner
so directed when such direction signs are installed by said authorities.

Union Township Ordiance's Chapter 266 - Part 1 - Article VI Ordinance number § 266-46

In accordance with the provisions of § 266-8, no person shall make a turn of the kind designated below at any of the following locations:

Some of the google streetviews are 2 or more years old... and it's not available for the area anyway. I'm just going to go back today, I brought my SLR that takes nice photos. Hopefully I was correct about there not being a sign posted...

If not, I can just go to the traffic court and ask for leniency, being my first moving violation and all. Literally one month to hit until I turn 25 and my insurance rate was going to drop like a rock.

^ I agree. Illegal or not, if there's no sign a judge should dismiss the ticket. The general public can't be expected to keep up with ordinance updates and know which roads have which laws.

Update: not guitly due to improper signage. The judge apparently has been pulled over for it before, and threw it out.

If they weren't willing to put forth the effort to make a 'no left turn' sign, then clearly it isn't a big deal and they wouldn't have a problem dropping the ticket. Just my .2
