Anyone else see the news last night on CW? There was a segment on how Mass cops are being asked to give more tickets to increase revenue to the state, and people are freaking out because it's about as illeagal to do that as it is to have a ticket quota.
Gee, I wonder if your ticket was a result of the want for increased tickets!! (note extreme sarcasm)
Definately fight it. Someone said cover all your bases. Do that! Get something in writing from Mazdaspeed, either the decible rating which they should have, or that it is a certified MAZDA part, and not considered aftermarket, therefore fully legal. Have it measured and bring the rating to court with you. Bring all the pictures the other person suggested. AND ASK while in court what the cop measured the Db at and if that Db violated the noise ordinances. Loud to him, might not be loud to others. Sensative hearing! Use everything. He should be pulling over the people like the jerk that ran 4 red lights in Newton last night and almost clipped me.
I still feel strongly that it is a secondary offence for the reason that I myself got pulled over for loud exhaust a few years ago. NOW I on the other hand deserved the ticket (driving with just about open headers, exhaust was bolted on but not correctly, as I was taking my car home from the shop to the house to finish work after a motor swap was done.... heheh ) BUT the cop flat out said to me, "you are lucky you weren't speeding or I could be writting you several tickets right now, but I can't."

heres a good for your records. have any harley davidson group do a drive by and see how many tickets they issue..i think all harleys rule in there own right and a lot of these guys are lawyer's and it be a good test of your police department charges with out reason..i think that sucks big time when you know most trucks and diesals make a hell of a lot of pure noise!

Thats weak, you should just speed everywhere now so you will get some enjoyment out of getting a ticket. At least they will have a reason next time...

^I seen that story to Krysy.. and get this the police union is trying to fight it saying its unfair and punish's those who dont give out tickets and rewards those who do. Aparently if you give out a ticket you get a hour's credit of OT but only like 30mins if a warning is given. So when the police officer pulls you over well statie rather I should say. You have to think to yourself "Has this guy paid all his bills this month yet?". Now I'm sorry I know the police have a job to do and pulling us over is part of it but it should be left up the officer without any outside pressure of giving a warning or a ticket. If I'm caught doing 50mph in a 20mph oh yes give me a ticket I deserve it. If I'm caught doing 50mph in a 40mph give me a warning and tell me I'm a moron and should be careful next time.
Back to the Exhaust's.. again cover your ***. I forget if Rt's are considered state or town owned roads. This will help if the officer claims "Our Local Ordinance states....." then you can retort with "I was on Rt... and its a state own/run road hence is covered by the states ordinance.". Longshot maybe but hell find out man. Me I'm lucky my brother just became a officer so I can just ask him any questions about legality and crap. Still love his responce about tinting my windows "Dude we dont give a **** about that. Half of us have illegal tint on our cars already, as long as you dont **** us off we dont care."

I've come to the conclusion that I seriously woke this cop up from his nap. I mean he didn't have an attitude when he was speaking with me but he actually said to me "I wasn't even watching the car for a moment and I heard yours go by". I mean...come on. I have actually seen cops sleeping before (usually on half finished construction sites that my father is working on) so its not like I'm just thinking the stereotypical thing. Yes the mazdaspeed drones somewhat at 3k rpms going up a slight incline but it is by no means pull me over loud.
I plan to take a decibel reading myself...with a picture of the meter. I will stop by my dealer today to get some rattles checked out and ask for something from mazdaspeed confirming the legality of the exhaust.
Your probably right krysy about this being part of the "quota" of tickets they have to give out...I just hope he doesn't even show up to court or the judge instantly decides its legal since its a Mazda product...

Last I knew if it came from the dealer it is ok to have on the car, so since mazda offers an exhaust upgrade that doesn't void the warrenty and can be installe d from factory, this shouldn't be an issue. This would mean any factory addon is technically illegal.

I grew up in MA, and one of the things I hated most about that state was the state police...
Nothing like working a 12 hour shift, driving home at 2:00am only to get pulled over for doing 70 in a 65 on 24 south.

Update: had my "court case" if you can call it that today. I won, simply stated that mazdaspeed is OEM equipment and thats what the law says. Judge asked the officer if he knew about this law and he raised his shoulders, litteraly 1 minute in and out. I also brought a picture of mazdaspeed engraved on the tips for proof. It took place in a small meeting room with the judge, officer, and myself.
