so then, why not sue the owner of the track because they provided the track and have profited in doing so, hence a case of vicarious liability.

This country has unfortunately become one where somebody else is always responsible for your misfortune regardless of you knowing and agreeing to the risks. No wonder all types of liability insurance have skyrocketed.
I totally agree. It is ludicrous what has happened.

Smooth if those are your concerns then why turn up!
They are not concerns. I actually see it as a bonus. Also in all honesty would I go them if someting went wrong and I had signed a disclaimer? No. Have they set a precedant by organising the day? Yes. Is that good as far as I am concerned? Yes.

the ludicrous situation has occured because people always believe somene else is to blame. For example mazda organizes a track day with instructors where you can enjoy the capabilities of your car in a controlled environment. You then decide to keep your car as a strict track day whereby you submit it to stresses 20x the amount you will encounter durig everyday driving. An incident occurs where our brakes warp after heat production from 30 high speed laps of Mallala,notoriuos for cooking brakes. Naturally it is Mazdas fault becasue they promoted this behavior by allowing you to partake in a controlled track event with an instructor and you chose to take it one step further. Warranties cover faults occuring during the course of everyday driving exempt from the stresses of track driving.


I had a situation once where a person noticed a slight bruising after I administered an injection. naturally it was my fault and that person was awarded $1000 damages. The situation is the same!

I better sue a dentist making my teeth and tounge numb and cannot enjoy my meal for the whole afternoon!!!

I too have been on the wrong side of consumerism before. Our own Professional Indemnity premiums have quadrupled in the last 3 years as a result!

I commend Mazda for organising the event. I am going and hope to enjoy the day. I was not trying to be negative about the situation with Mazda. I was simply pointing out some realities about the society that we live in.

Lets not jump to any hypothetical conclusions about what might
transpire if something might happen.

But I have seen plenty of RX-8's do lap after lap at Wakefield. Yes - I know it is a different circuit. I have also seen some do 8 laps at a time at QR without any problems.

I would venture to say they (RX-8) stand up to the rigors of the track in stock form much better then just about any other mass produced production car. They just seem to go and go and go.

And one more thing,

"Everyday" drivers like us should not be attempting to do more than 8 or 10 laps in a row at 10/10th's. That is when the brain fails and then you experience a whackfuck.

The first time I saw it used was on an offical sign posted by the track officials just after a corner on the last competitve stage of the Mobil 1 Round Australia rally in 1996 (??). I saw the officals place the sign with my very own eyes. It was indeed a Wackf*ck - I have it on video somewhere. When you are that brain-dead the wack happens before you can react!
