Dealer messing around...???

Have inspired a mate to trade in his Rx-7 for an Rx-8 & last weekend on "M-day" he signed on the dotted line with a certain Sydney dealer for a new leather pack with sunroof RX-8 at a driveaway price of $55k with 1 year rego (if memory serves me)

He basically is doing a $25k change over deal on the Rx-8, so $30k for his "series-8" Rx-7 is a good deal he thought. He scored a few goodies on top as part of the M-day special too so all sounds good...................... until!

Wanting the winning blue, the dealership signed the agreement stating they would supply the desired colour but now have come back saying there is one left in Oz & the Brisbane dealer that has it now says its sold despite showing up as "available" a few days before.

Cue 2nd choice colour. White

Dealer then comes back & says there are no "white" Rx-8s left in Oz. Stating that "In fact, they are a discontinued colour"

So he gets told in no uncertain terms... "Your choice is red, grey, black or Satellite blue" Take it or leave it. (amazing service for a $55k purchase hey!!)

Disgusted with the whole thing, I showed him the "40th Anniversary" RX-8 thread & he loves it. He now wants a WHITE Anniversary RX-8.

Can he instruct the dealer to order him this car & complete the existing deal or will a new deal be required........???

He is fearful they will try & screw his trade in deal down further & bump up the price on the Rx-8 now they know he wants one & has already gone this far. So he is keen to get the 40th Anniversary Rx-8 but as part of the original deal.

Can this or has this been done....???

Short answer is that if you change the subject of the contract, you're looking at a new contract (i.e. the old agreement no longer applies and everything is up for negotiation again).
