I can't find the tsb on the bimmer forums but it looks like people have already got the new firmware and it does fix the lag problem.

A friend of mine is the tech at Sterling BMW. He's going to notify me as soon as the new reflash is available. Most of our tunes fix lag already however.

Sorry guys I simply have too many pictures of RX-8s taken over the past several years to desire taking any more. Blue spots occur when people move around in the picture too much...
