today around 4:20pm me and my friend were walking toward Kragen to get oil filter for his car. When I cross 3rd and Geary, a corolla/camery bump me @ about 20mph, ambulance came and I was at the hospital for 7 hours, I'm lucky I'm still alive!!!! The driver is a old lady, she's making a LEFT on Geary and careless of any pedestrian, and I'm the victim. Anyone know if I can file a lawsuit or clam? I have 2 police report and 1 witness. sigh~ what a day I had....

But you should be able to get a lawsuit through pretty easy one would think.

I would think you could sue, but you have to have damages -- injuries, lost time from work, future treatment needed, etc. -- to make it worthwhile. If it's anything like Philly out there, I'm sure there will be tons of lawyers who will jump on it! lol Good luck and glad you're okay

wow. i know there's the guilt factor of going after an old lady, but ****, that's not fair that old people can keep driving and they're trying to take away teen's rights behind the wheel. hope everything works out. keep us posted.

Why sue?

Sucks to get hit, glad you are okay, but this country is a little too lawsuit happy.

On one hand you say it was just a "bump", on the other hand you say you were in the hospital 7 hours and lucky to be alive. There seems to be a little disparity there.

as for injuries lucky I had no broken bone
but my right hand and both my leg are wrapped with gauze and I could only type with my left hand right now
doctor said no driving and no running for at least a week
I'll go talk to my insurance tomorrow and will make some phone call to lawyer
It's still a very scary sences thinking back from now
I was crossing and all of the sudden something hits me HARD I rolled up the hood and rolled down to the ground and she still didn't stop that damn car until I'm down.
I'm angry because i heard her daughter said to my friend I should watch out for other cars even on green light and we shouldn't blame her mom and this is a no right or wrong accident. Smart *** daughter huh and the lady looks old enough to be my grandmother.

 

damn dude that was crazy! sometimes walking on geary is kinda dangerous cause i almost got hit hella of times. glad you are ok man! i would sue the f*ck out of them for that and mainly because the daughter still gives an attitude as if they didnt even give a sh*t that they hit you. anyways get better soon.

Yeah I totally agree with SILVeRE8 that you should sue, especially after the daughter blamed you for the accident. Well according to the DMV book, it says that the driver has to yield to pedestrians even if the cross the road by J-walking. If you sue, you should win since she was at fault and could have severely hurt you. Also, luckily you have a witness on your side. Anyway, glad you are okay and hopefully things turn out well.

 

go through insurance, im glad you're ok man! im in frisco all the time and always always look and think twice before crossing streets, scared as hell that something like this will happen. anyways, i dont know about a lawsuit, just insurance but trying doesnt hurt, maybe just financially
