Question Tranny grinding / canada warranty issues

I have a 2004 8 with 23000km on it. About 1 month ago I brought it into the dealership because 4th gear was grinding all the time on the downshift into 4th and above 3500 on the upshift into 4th and getting worse.(they said they would fix it but only if i put a new clutch in, cause they said the clutch caused the tranny to fail) the clutch that was in the car was stock, so i took this opportunity to have a custom clutch installed with a kevlar plate and presure rated for up to 450hp, the dealership installed it.

Now i have my car back in the dealership for the exact same problem with seconed gear and the same thing starting to happen with 4th gear. The dealership is telling that it isnt covered under warranty cause my back tires were bald. I asked how that caused the transmission to **** up and they replied with "it is grinding because of the way the car was driven". I have brought them about 25 posts from this site showing them that other people have had this problem and even asked them to look at the clutch fork as that was posted in a few of the threads. Mazda is doing everything they can to try and stick me with this bill ....

anyone got any advice or contacts that might be able to help me out with this one?


also im getting between 240-260km per tank i didnt think that was normal and i asked them to check it out but they havent done anything about it yet

Thats ridiculous, I had my tranny replaced... second gear was grinding always and then one day I punched it in 1st gear and went to shift to second and bye bye tranny, it took them forever to fix it also(1 month)... they wanted to fix just the gear and not the whole tranny and said that they couldnt actually replace the whole tranny... well talked to their dm and he had them put a whole new tranny in... Don't have them just rebuild your tranny, theres no way they can remove all of the small broken pieces in there...

I'm having the same transmission issue. My gear has been grinding for MONTHS now on my 04 rx8 with 31k miles. In the past two months ive had them look at it twice, and each time they say that the transmission is fine. I am ready to bring posts in off the forum and show them that there is something wrong with the tranny. There is another post on this somewhere. Does anyone have any tips on how to get them to actually FIX this? I mean, they just replaced my catalytic converter which "got clogged up" due to an engine misfire and ended up MELTING the carpeting in my car because it got so hot. Yet when i ask them to check out the tranny, they just tell me its fine.
