From the research I did, most of the west coast states have specific DMV rules as to when a rear-fog light is allowed to be illuminated. Many of them it's in the 500 feet or less visibility range.
Midwest states like where I am from tend to not have any specific laws about rear fog lights. They are legal, but there is nothing to indicate when it's allowed to be illuminated (or not.) Here in MN they have an "excessive lighting" statute. A few officer friends mentioned they could write a ticket to someone with a rear fog turned on based on that rule, however they were unlikely to unless the light was visually impacting someone following them.
Due to the brightness of the rear fog, I'd certainly consider it to be distracting if I was following an RX8 at night, that wasn't in either heavy rain or heavy fog.
(Note, turning that light on in fog or rain conditions really causes the drivers behind to back off.. So I'm certainly an advocate for having it.. but using it responsibly is the key!)

It's fast...get in contact w yuki by email or use their website...if website choose "shipping to door" unless part is too big which will require u pick up at airport.

Well, here it is. Its wired straight to the tailights, so its on when the tails are on. Swapped out stock bulb for a 9 LED bulb...poor quality cell phone pic

Where'd you get the LED Tail Lights? Or are those the stock 2009 tails? I've been looking for these forever.

It's funny, I usually have to check my brakes right when I can see the guy behind me pick his nose, or the woman texting (Tail gating & texting. really.)

I did mine around Christmas. I was going to make a writeup with pics. Hopefully soon. I used most of the wiring from the JDM kit but you have to mod some of it.
