Thanks for the link, Invasion. It looks like that recall is valid for my car and it probably hasn't been done because I could not find that campaign number on a sticker. So I'll bring the MSP to the dealer and ask them to take care of it. It sure would be nice if it took care of the CEL.

I called MNAO about MSP16, it is a service bulletin and not a recall. It also falls under the emissions warranty, which is good up to 80,000 miles. Although, they stated that the dealer will not reflash your PCM unless they feel it will solve an existing problem, meaning they have to diagnose your RX-8 with a problem before just reflashing your PCM on request. The diagnosis most likely is the $107 to scan the CEL and troubleshoot it. I am sure every dealer is different and some will do it for free but MNAO's stance was the same as my dealer. Just for info....

Well I decided to take the ride into the dealer to get the reflash to see if that would improve my cars performance and clear the CEL. When the dealer got the car in the shop they decided not to reflash the PCM and to investigate the CEL instead....the technician deemed that the PCM needed replaced (as I suspected), although the replacement is actually covered under the 80K Emissions Warranty (I was at 75k, so close to the edge)! I was not aware of this and was surprised. If I would have known I would have brought it in 10 months ago when I began getting the CEL. The other bonus was the service department didnt charge me a thing.
As of right now the PCM is on order. I will provide an update when it is installed. Hopefully the performance improves and I remove the rainy cloud that has been hanging over my ride for almost the last year.
If anyone else has the same issue and is below 80k, bring it in and see if they came to the same conclusion and replace your PCM for free. I did not see this mentioned elsewhere on the forum, so I assume this is not widely known.

The new PCM fixed the CEL I was getting - so no more. Although the performance did not change - it was basically unnoticeable beyond not having a CEL light.
Furthermore, I brought it back to the dealer for further troubleshooting (rough idle, hard starts, etc) and they first replaced my CAT, which did not improve things to much of an extent (little better start, not much). Interesting thing, once they put the new cat on, I started to feel a hesitation around 4250 rpm (around when the SSV valve opens) when under high load. Not sure why a NEW CAT would do this....
Second, they pulled a compression and found it to be border line. They recommended to Mazda that I get a new engine. Mazda agreed and a new engine was installed. The new engine improved the hard starts to some degree and rough idle, but it still is not right. Intersting enough, the hesitation at 4250 rpms is still there under high load, but not as bad....not sure what this might be (carbon build-up?). Might be going back for another trip to the dealer soon. The great thing is this was all under warranty, I am at ~ 78k miles now.

New engine should have rectified any carbon issues, did they replace your spark plugs...what are your Coils like???leads???
SSV, there is a replacement TSB/ Mod for this one, don't know if your dealer has or did do this..
From Memory I thought the SSV's were not actuated until around 6250 RPM???

During the engine replacement they noted some carbon build-up, which could have been due to the miles on the car or the wrong A/F ratio with the bad PCM. At any rate, some cleaning was conducted, not sure how much though. Thought about de-carbing the engine to see what that would do. As for the TSB for the SSV - not sure I know about this one....do you have a link?
I thought the SSV was actuated lower...anyone else know?

Thank you to all who posted to say that the PCM is covered under the emissions warranty. I finally gave in and took the car to the dealer (yeah, it took me a year to finally get around to it). I got tired of seeing the CEL and the cruise control stopped working recently (it just won't turn on any more). They read the code and told me the PCM needed replacing and it would cost me a total of ZERO dollars.
I like that answer.
However I told them that the policy of charging $100 to read the code was just plain stupid and was the reason I delayed so long in taking it to them. They waived the $100 after they determined that the problem was under warranty.
So I have to take it back in next week to get the new PCM at which point I'll find out whether the cruise control problem goes away.

96k miles 04 AT
I have this po610 issue too and I am out of warranty. Car seems to run fine. I really don’t want to pay for a new ECU, just want to get my car pass emissions don’t really care if the light comes on or not after that. Any suggestions?

passing emissions with this problem
The quote from the DMV's website is "If the emissions inspection analyzer detects at least one emissions related Diagnostic Trouble Code that causes the Malfunction Indicator Lamp to turn on, the vehicle will fail the inspection."
I found out that if I drive the 8 for at least 15 minutes then cycle the ignition (ie. start then turn off) 4 times the CEL will go away and not come back as long as I keep the 8 warm. The P0610 code will still be stored, however according to the DMV if the CEL is not tripped by the code you should beable to pass emission inspections. I will try this and let you know how it goes.

So the proceedure I listed works for passing emissions ... One thing to note is if you had the CEL reset using a code reader you must drive the car at least 35 miles and have one cold start to get two of the OBD test completed before getting emissions.

Anyone ever find a way to solve this code?
Mine started a few months back. It disappears when amb temp is hot enough and the car is running warm. Seems to come on at every cold start and when I clear the code with an OBD2 reader it immediately comes back on. Will have a closer look at some of my ECU wire connections but just wanted to see if there was any updates on this in the past 10 years.
Performance of the car is not affected, AFR's are still where the should be and it seems to run normal as always.... just very annoying to not have cruise control because of the CEL.

Engine light no exceleration
If my light comes on I have no exceleration but if I disconnect battery light goes off car works fine again what could this be from? Abs and dsc light has been coming on also. I tried to change the third brake light switch and it turned my brake light on with out pressing the brake so put old switch back on. Cant afford to take it to garage in florida near fort Myers can anyone tell me what could be wrong?
