Broken Emergency Brake Handle Housing?

So I, like many of you have had the "stiff" emergency brake in cold weather. Doesn't lay flat, and sometimes engages the emergency brake light. Well, it seemed to get worse, and then the other day it was fine. I looked down, and the casing on the front side is broken! I can see the gear mechanism and grease inside. The nice thing is that the brake has never worked smoother, but it looks like crap! The car is only 9 months old - is the dealer going to cover this? I never forced it, and it just seemed to crack. Anyone else have this happen? I'd be tempted to leave it since it works better now, but if I sell it I don't want it to be a detraction, but it looks lousy. I'm also afraid junk could fall into it now and mess up the mechanism.

I am sure that it is a warranty item unless there are definite signs of abuse.

Mine has is the same, getting done under warranty, The new one will have to have some lubrication as it's a very tight fit where it slides.

There's another thread on this a couple of days ago:

It should be covered under warranty. I had mine replaced but it broke again a week later. It's futile to replace it during the cold weather. I'm waiting till it gets warmer for my 2nd attempt to fix this.
