Look at my avatar, you can read the one I designed from a block away.
The reason is? It lets the light form the RX-8 Logo instead of blacking it out to form it. This is the correct method of lighting. I have never seen any of the decal pictures taken from more than a foot away. I can post pics all day long of ones that are of my design that have been taken of the entire rear of the car.

Here is the law governing the third brake light...
Each passenger car manufactured on or after September 1, 1985, and each multipurpose passenger vehicle, truck, and bus, whose overall width is less than 80 inches, whose GVWR is 10,000 pounds or less, manufactured on or after September 1, 1993, shall be equipped with a high-mounted stop lamp which:
(1) Shall have an effective projected luminous area not less than
4 1/2 square inches.
(2) Shall have a signal visible to the rear through a horizontal angle from 45 degrees to the left to 45 degrees to the right of the longitudinal axis of the vehicle.
(3) Shall have the minimum photometric values in the amount and location listed in Figure 10
Information derived from:http://fmvss108.tripod.com/fmvss108text.htm
The FMVSS108 is the federal guideline for vehicle lighting.
So, what this all means is that the total lit area must be 4.5 square inches and that the light must be viewable within a 45 degree angle from side to side. The photometric value requirement is derived with the stock lamp that is in the housing.
Can a cop pull you over for either mod? Even if the cop doesn't understand the full extent of the law, he can pull you over for anything he sees fit for. First off they would have to fully understand the requirements and secondly both forms of this mod are within the full requirements of the law. I have measured the masking of the one I have and it does provide more than the minimum requirement of 4.5 square inches of effective projected luminous area as well as the sticker method does too.
