Front end Damage!!!

Ok, so some jacka$$ backed his rented land yacht into my 8 this afternoon. Believe it or not, this moron's first words were "didn't you see me backing up?" Here's the scenerio:

I'm comin down the street to pick up a young lady to go to her sister's cookout. As I'm coming down her street (which is an exceedingly narrow residential street), there's a new 4runner about 10 car lengths in front of me. He's driving as though he's going to try and find a place to park or gonna stop to pick up someone, so as I closed the distance between us, I left him about 2 or so lengths of space between us so if he were to stop suddenly, I wouldn't rear end him.

He eventually stopped in front of a house, so I'm thinking he's going to wait for someone to come out of the house and get into the car. Now, mind you, where I stopped (2 car lengths behind him) there's a space next to me, and unbeknownst to me, he intends to park there. In any case, I look down to pick up my phone to call the young lady to ask her to come outside, and when I look up, he is backing up and is practically right on top of me! And before I could get outta 2nd and into reverse, the retard backs his boat into the front of my ride!!!

Now, I would think that if you're gonna drive in reverse (for whatever the reason my be), you would LOOK where your going! If there were someone behind you, I would think that you wouldn't just ram them, but that might be asking too much. Surveyign the damage, I found that dents, scratches, and scrapes resulted from the collision. Either way, I got whatever info he had (name, address, license plate #, driver's license #, a copy of the documents that he had from Budget car rentals, phone number, etc.) and went to the police station to file a report. At the station, I was told that since no death, injury, or tow occurred, the police wouldn't file a report, and the insurance company (mine or Budget's) wouldn't ask for one.

So, I'm gonna wait until tomorrow and go see my insurance people and give them the info to go after budget or the driver for the repairs. I'm so pissed... Any advice?

Twice people backed into my Miata. I can't believe he had the nerve to say "didn't you see me backing up!?"! That's bullshit. What if it hadn't been your car, but a little kid??? It's HIS responsibility to NOT back into anything. Or anyone. *******.

Did you snap some pix that you can send to your insurance company? Some people keep a disposable camera in the glove box just so they can take photos in the event of an accident. Good luck!

I know how you feel... On thursday of last week. I went out to a club in Hollywood for my brothers BD. I parked and went in.. When I came out I let my wife in the car and herd a faint but noticeable crunch noise... I thought to myself what was that... maybe a waterbottle or something she stepped on.. whatever.... I walk arround my car and let myself in the car and herd a much louder crunch noise... I was like aww hell naw... WTF is that... I get out of my car walk to the front and to my dismay my new carbon fiber front lip is all smashed up and is sitting on the parking brick thingy.. I was like aww hell no did I do this.. When I parked my radio was off and I am sure I would have known about this... I then proceeded to walk to the back of my car. I see on the drivers side the rear bumper is popped out a bit.. I was like AWWW ****!!.. got to the back and some dick hole hit my car... I know the vehicle was white because he left his mark on my car.. he also scraped the bumper and put a hole in it.. the plastic molding on the bottom by the left exhaust was smashed up to.. Whatever jerk hit my car (and left no note) hit my car and pushed it into the parking block.. So now my car is in the shop and getting fixed... I spoke to a cop that was there around the club said that there is nothing I can do but to call the insurance company. No report was needed.. I hope the jerk who hit my car gets the clap and crabs all in the same day..

this a huge load of crap.....the police are there to serve you and i would go back and demand them to do the job they are paid to do.....absolutely the insurance will need a report...keep in mind his back hit you so without a report he can easily say you drove into him....

chris.........just shhhhhh

I feel for ya there are some real stupid people out there, my rx has been hit twice from stupid people ive been backed into and rear ended.

Here in New Jersey if the police weren't called to the scene of an accident we dont have to take the report for the same reasons. But we have a state accident form which you can fill out and send into the state so that way it is reportable.

They also gave me a "Non-reportable Accident" form, so if it's requested by anyone, I'll have it on hand.

Update on the situation, I called Budget today to inform them of the incident, and to find out what the process was for me to file a claim with their claims dept. Come to find out, according to the guy on the phone, they've been tryna get this car back for almost a month now (why they never reported it stolen is beyond me...)! Also, this a$$ didn't get their liability coverage, and all of his phone #'s are disconnected. They said that since he didn't get their Liability coverage, his insurance company is on the hook for the cost of the repairs, but they couldn't provide anymore info until they got into contact with the driver... I asked what recourse there was if this individual didn't have insurance, and the guy said that they (Budget) would be responsible for the state minimum (or someting to that effect, not sure if those were his exact words...). However, he would see if he could locate the number for the claims department (he didn't have it handy at the time...), and he would call me back.

Now, this whole situation struck me as odd right from the get go. I would think that they wouldn't have given this guy the keys and let him drive off the lot if he didn't purchase their insurance or leave them a copy of his personal vehicle insurance card. Also, why do they need to wait until they get the car back before they can give me more info?

Furthermore, this guy is apparently staying up the street from a friend of mine, so I had her stand on her porch and see if the car is still there: It was. So I called them back (by now it was almost 5 p.m., and I'd initially called them around 9 a.m. and I'd not received that return call with the claims dept. #...), and informed them where the vehicle was located since they were looking for this vehicle to try and repossess it. A few mins ago when I dropped my friend off (around 11:30 p.m.), I drove down the street and saw that the car is STILL SITTING IN FRONT OF THE SAME HOUSE IT WAS AT EARLIER!!! This begs the question to me, how hard are they trying to reclaim their vehicle? Is this just a ploy to try and give me the run-around?

Either way, I'll be speaking to teh people in the claims department regarding the incident (woulda done it today, but they closed at 5, and I didn't get their # until shortly after 5...), and putting the process in motion to get my ride fixed. Otherwise, I'll have to go thru my insurance company. Now, my main reservation about this is that they will give me the cost of the repairs minus my $500 deductable. They'll then go after whoever is responsible for my $500 and send me a check whenever they get it, but who knows how long that will take... Hopefully, Budget will cough up sufficient cash to return my car back to factory form (I figure that the most I'd need is a new bumper cover and have some of the brackets and fasteners replaced as there's now a bit of divergence in the seam between the hood and the bumper).

I'll post pics sometime tomorrow...
