You have to be part of a military family for USAA right? I think I remember checking them out once and taking them out of consideration for some reason. That was probably it.

If you have uninsured motorist coverage, you should not pay any deductible at all, assuming it's not your fault. Good luck in getting your ride back on the road!

Ken I wish it was that simple but the laws here in Dallas are crap. My insurance company sent a tow truck out, and were going to take it to the shop of my choice. But the city has a law that if the police are called out the city tows it(Sec15D-14). They said it has something to do with keeping scum bag tow truck drivers off the street. I see how thats no different than the driver that towed my car but not to the shop my insurance company stated to use. The company they call can only tow it to a shop they have a contract with. I was working with my insurance comapny today to get this fixed. They said they will get it over to the body shop I originally wanted the work to be done at.

As far as the engine goes, My insurance adjuster is going to work with me on getting the car to a better shop to have the engine checked out after the body work is completed.

To answer another question. Yes USAA is only for military service members and thier families.

Bummer, Doc. Makes me cringe. As for USAA, nobody can beat their premiums, but when it comes to payout, especially PIP, they're as fraudulent and twisted as anyone else. Hence the class action suit.

If they total it then I will take that money and use it to buy a newer one. I will put the old hood back on, take my spoiler off, and a couple other parts.

Nothing wrong with it getting it towed twice. I've had that happen a couple of times - truck called by the police just took it to their yard, then another truck took it where I wanted. My insurance company covered both tows each time. Glad you're insured by a good company.

Yeah I have been kind of lucky, so far they have every intention of fixing it. They said they have it at the right shop now, next is they plan to work with me on the parts. They said if I can find and run cheaper parts whats left over is mine to play with. They seem to have every intention at this point at fixing the car, I will keep praying that things turn out that way.

They have also started an investigation in to my engine situation. I had a 45 min talk on the phone with a claims specialist. He told me they have chosen two shops, and they need me to make the final decision to check the engine. If the engine was damaged they will be holding the first tow company liable. I asked them exactly what needs to be done. They said that with the photos I provided (specifically one showing oil running all the way down the street past the car) they could make a case against him. They will be having someone contracted out from whichever place I decide to be testing and checking the engine for damage. (Both shops I trust to work on rotary engines dont do body work). They will have the engine tested and completely examined at the cost of the tow company should anything turn up. That was a huge relief.

Whats not a huge reliefe is that I have started doing some research. The headlight alone is 1K. The front bumper, under cover, front air dam, inner fender wells, and all the plastic that has been busted is well over 1K not including paint. A small amount of damage has been done to the the lower tie rod. They need to check for damage to the power steering unit once the suspension is re aligned. The fender is not cheap and will need to be painted. The wheels have to be very carefully removed from the tire, and sent out for repairs. I would assume them to do both to make sure the paint matches at least on one side. The CF hood needs a new clear coat.

The good news however is that all the JDM parts they said they will replace with JDM parts. As long as it has a mazda part number I was told whatever the price is from Japan is what the estimate should read. They also told me that since the oil cooler lines are 1200, and the replacement racing beat lines are 400, that the 800 dollar difference can go to a custom front bumper. (I like the stock fenders, and they will cover the cost of CF fender vents).

A lot of this is falling in to place fairly well. A really good plus also is that so far they want to fix it, and not total it. Along side the fact that they are going to have the engine examined by someone experienced in rotary engines.

Looks like things aren't as bad as I thought they would be, and USAA has really been extremely helpful. I would have pushed the car issue more for my rental car, but I have my 1958 prosche I am driving. Because of our tornados and serious hail storms I cant seem to get a rental car until monday. Thats fine though because I have a second car, and the 30 days doesn't start until I chose for it too.

It's not the illegal part that's the problem. It's the uninsured. I've had two cars totaled by full-blooded US citizens who had no insurance. Irresponsibility is independent of citizenship.

That the guy who hit Doc is illegal does carry the satisfaction that he's probably now in INS's hands and will eventually be deported.

I wouldn't really call that satisfaction. He gets deported and makes his way back here the same way he came the first time, with 0 consequences. The only person getting screwed here is the OP because he has to pay for another persons mistake and lack of responsibility.

Yes - Doc and his insurance company are the losers. But at least the perp will get ground through the system. Which is more than what happened to the guys who took my cars out.

Hopefully the deportation will happen after suitable jail time for driving without a license.

1.8L H4 with dual 44mm carbs, electronic points (takes away need for timing engine), electronic choke, eagle thunder cams, empi 4 in to 4 out straight pipes, 5 1/2 pound pulley, 30GPH fuel pump, and a 4 speed pro street racing transmission with a hurst shifter.

We have a lot of that around here. A hand full of families get slave labor and the rest of us pony up so they can have that. We pay for it in ways most don't even think about. Higher insurance rates is one of those ways.

Remember you can also find used parts (fender, headlights)

You dont need to get brand new parts and that also gives you more money to have to go into other stuff....the lights alone are 2k+ from mazda you can get a set for like 1200 off ebay

That is nice!! I'm not feeling quite as sorry for you any more. Beats the socks off having to drive my wife's Camry last week when my 8 was laid up with shock and coil problems.

Love those older cars where you can actually see all the parts, and there are parts like carbs that you can work on. I'd never know as much about cars as I do had I grown up these days.

Really glad to see your update on how USAA is looking after you. Nothing like having a good adjuster on the case. Hope you get the 8 back on the road soon.

So I have been in the process of fighting over totaling the vehicle. Then today a check arrived in the mail. I guess they sent it anyways even though I didn't want the vehicle totaled. Well once this check arrived I changed my mind. They are offering 15K for the vehicle. Its an 04 with 83,XXX miles on it. Original engine, and only a handful of mods. I am going to try to salvage only a couple of parts on it. The hood, the illuminated shifter, and I was already able to salvage the two tail lights (brand new with sealant on them). After I saw this check I had to go ahead and let her go.



I figured you guys would want a photo so there you go.
