NO DOUBT. I swear I must have about 50 bucks in change under the seat that I can't for the life of me get to. Joking aside, I love the car. Now, I was one of those unlucky few that had to have the motor swap (it's an 04), but other than that, the darn thing is tip top...really, I have not experienced ANY problems at all with the car. I've got about 53k on the body, and maybe 3-4k on the new motor. OH, and one thing that I find interesting, the darn thing will hold an alignment. I got some new tires a couple of weeks ago, and had them check it, it was spot on. And the last time it was checked was about a year ago!!
Rants:
1. Center armrest sliding rail tabs break too easily from some schmuck at the dealership getting into the car and leaning on it too hard.
2. E-Brake tab snaps off (TSB yah yah, but even replaced in the cold weather, it snaps right off!)
3. RATTLES!
4. Leather seat plastic framing at the bottom splits.
5. Stubborn reverse gear not going all the way in all the time.
6. Small trunk opening.
Raves:
1 - 100. Everything else.
---
Consider me highly satisfied after over two years and 42k miles on my car. Can't wait to go FI!

Is it grinding (noise) in sixth gear while driving..
Or a Grinding when you change Into 6th Gear?
Plus, How many miles have you done

)What I find with mine is when going into 6th gear it is not a "straight in process"
if you want a smooth change, I find I have to pull the stick to-wards my left body side very slightly and it slides in nicely with no resistance.
So, in your case it would be sliding in away from you or to-wards your Passenger.
I hope you understand what I mean, at 1200 miles I don't have any GRINDING noises, of course the gearbox is loosening up with more miles.
I STRONGLY suggest if you have done more than 3000 miles to go and get the OIL CHANGED to a good quality synthetic gear oil and do the differential while you are at it.
I know Mazda don't recommend a changed, but I don't care, many years ago they did changed the oil at 1000KM (600 miles), and you always would see fine metal particles in the drain plug magnet that would get wiped off.
Your 24,000 or 30,000K mileage oil change is too long for the drive train.
I am not suggesting anything with you, but I find with Mazda gearboxes you have to use a "Light" hand, being too physical or heavy handed tends to show up issues.
What I am saying is look at your technique when changing and evaluate, it may help.
the grinding is now a progressively lower speed. it will now some times grind at 45 to MPH. if i shift very slow like trying to double clutch it will not grind. that is what the mech at the dealer did. he took a full two seconds to shift. now i am not speed shifting or banging it in.
also i remember another thread where two or three other members have had the same problem. in one case a specialist was sent out with a special part to fix the problems.

There were some problems with early 04-06 models, but your transmission is a new heavier duty one from the MX-5/Miata.
OK, did some more investigation on my Mazda EPC (Electronic Parts Catalog).
Mazda Changed 6th Gear around 120 RX-8's after mine, so around September 08 Production last year.
Part number was, P603-17-630, NOW P610-17-630 with an interchangeability code of "AN" which means New part will fit and replace old Gear, BUT you can't fit an Old (P603-17-630) Gear in the newer Gearbox. So the interchangeability goes one way only.
I can not tell you the reasons at the moment, but it is obviously an issue with 6th gear for Mazda to change it.
I know my dealer replaced a gearbox in an R3 Demonstrator as 5th gear was damaged by a customer test driving the car.
Mazda Australia replaced the transmission with a completely new one.
I can't understand why your Dealer won't act, tell him that the gear has changed in production and see what he says, last resort contact MNAO.
i found the thread.

i know that the dealer will fix it when it gets really bad. i just am upset that i will have little pieces in my tranny causing problems that they will not replace.
and yes i saw that part about not skip shifting
thank you

Have had my 2004 RX8 GT for a little over two months. Love it.
Pros: Comfortable, grips well, the short drifts I've had from her were like silk, good acceleration, smooth revving engine, well balanced, high revving, nice options with stock vehicle (I've got everything but navigation).
Cons: Not as fuel efficient (18mpg on average, but I don't mind), bumpy ride depending on road (sometimes enough to skip the CD player), little bit of a blind spot due to small back windows but manageable, trunk space almost too small for a decent toolbox with spare there.

Good comments mate, but I always fail to understand WHY people complain about Gas Milage...THIS IS A SPORTS CAR, not a family car.
If you are worried about fuel economy then you have bought the wrong car.
1- blown tranny on purchase
2- had a bunch of minor door bumps I had to fix (didn't notice till after I got home)
3- been to 3 dealerships.. all of them complete ******** to me
4- mazdausa insinuating I race the car, take forever to call me back, have to constantly be pestered to get anything done.. but they sure are prompt to send me the bill every month
5- second tranny has gears that randomly lock themselves out, grind, don't stay in gear, are rough/tough to shift, sometimes it'll even howl (I swear to god I was about to go into 3rd and suddenly this loud wail exploded out of nowhere and I dropped the clutch into neutral and it went away)
6- mileage is erratic as hell, anywhere between 4mpg to 20mpg city, 12-27mpg highway (I wouldn't mind if it was consistent, it makes gauging how far I can travel a PITA so I keep refueling at the half mark now)
7- oil needs fill-ups every 200-700 miles (also erratic, I now keep 2 bottles in the trunk)
8- A/C is never bloody cold enough, gave up trying to use it
9- defroster loves to turn itself off randomly, even after I just turned it on
10- has a tendency to switch itself to a very rich mixture lately
Apart from that I love it.. but I'm still very dissatisfied with it.. here's hoping Mazda eventually fixes everything -.-
(eventually being within a month or so)
