Unhappy OK, Sunlight Silver is cursed

This is twice now. The 1st time someone ran a stop sign and hit the rear right quarter panel and I had to get the car fixed. This time, I'm waiting for traffic to clear to make a left turn, and next thing I know, this car is sliding right into the back of me, probably not paying attention. Now as it turns out according to the officer, she doesn't have insurance. Now it is a law to have insurance here, so what the hell can I do? Do I have to let my insurance pay for it? Try to sue? (costly and possibly not effective), I mean you can't go around and be responsible for (I'm guessing due to my last wreck) $1,200.00+ damage of someone else's property and not be responsible for paying it. Twice now, both women drivers, neither one paying attention.

I'm so pissed.

Hello! Being in TN as well, also being consulted by our best friends which are husband-wife police officers, they said they hope you have uninsured motorist coverage. You can also sue the person and this may actually be the only way you can recover anything. If you are a vindictive person: since you are a party in the accident, you are allowed information on the persons citation and go to court and have your say as well. This usually gives the person higher fines.
One quick thing though... don't be too tough on the people just because they are female. I'm female in the same sunlight silver, and no dents yet. (Also it would be inappropriate to say, "and they were both hispanic/black/jewish", so why bring up sex!?!)

Just ask JensRX8, men can be just as accident prone! he he

So sorry to hear about silver's demise, and hope a quick recovery!!

I get run off the road by women in SUVs so often now that I have given up on getting upset about it.
I have only been run off the road by men when they are driving aggressively. The women are just unaware of their surroundings and usually freak right as they realize the mistake - so much so that the reaction is usually more dangerous than the initial gaffe.

I'm sure there is some reason for this other than the driver's sex (ie - distractions like makeup, cell phone, children, etc.), but this has gotten to the point that I end up in the dirt or on a shoulder daily.
Today, she turned left from the right lane of three at 35 MPH in traffic. Brought an entire intersection to a grinding halt.

You can take them to court and sue for liability. Under California law, if they do not have insurance, that does not give them a freebie to cause an accident. This will also enable them to take possession of the other driver's car, as well as take away their driver license.

I mean, this would be completely silly if people caused accidents, then said.. Oops, don't have insurance, tough luck... drives away worry free. Sue them, or IF you are really vindictive, tell them to pay you extra, otherwise you will bring them to court, and have their car impounded, and even arrested as a possible sentencing.

The one major accident in my life was similar, when the car hit me, didn't have insurance, and tried to blame it on the glare of the sun. Guess what buddy, he hit me, he pays. He tried to say.."Just use your insurance, it'll be ok." No it's not okay since it wasn't my fault, and I don't want my insurance to go up because of his dumbass. Sued him, claimed injury as well, got 8500 for injury and work lossed, had his car taken away permanently, and since he was an illegal resident, he was deported. Oh, you wonder how he was able to pay? He was driving a BMW 325Ci, and lived in Mission Viejo... 3 Bedroom house. Hmmm... I love how the law works.

Sorry to hear of your bad luck, I have the same color. Try driving with your lights on all the time you might find it worth the trouble.

Um, no offense Meowloud, you are the exception rather than the rule, yes men can be just as dangerous with vehicles, however when I am driving, the vast majority of people that are not paying attention are female drivers. I brought up sex because it was a fact that they were both female drivers, believe me I would be equally, if not more pissed if it were a male.
I do have uninsured motorist coverage, although it's a scam because comprehesive coverage will cover the same thing, which you have to have to finance anyway. So, I'm really not worried about it being fixed, as a matter of fact, since I was hit before, I'm sort of jaded about it now. Tomorrow might be a different story. I am vindictive, to a point when it comes to stuff like this, but I don't really want my insurance rates to go up due to something that was entirely not my fault.

Astor, I know how you feel! Makes me so aggravated that insurance companies DO take into account if you have been in an accident that is not your fault. These 'exposure points' make you more of a liability and they raise the rates. So unfair! You would think since it isn't your fault, that you wouldn't incur anything!

Don't get me started on insurance companies! I think almost all insurance branches (life, health, etc) need better ethics!! :p

It scares me. I am paranoid around every SUV I see, which I guess is about half the cars on the road. I tend to assume they have it out for me. Sorry to hear that.

I think the problem is there is no way to drive a truck other than like an ***. They defy all logic of road usefullness to most who drive them. I think people should be required to pass a special license to drive the largest of them like a bus driver or truck driver would have to. The few times I have driven one tells me they require a lot more attention to your surroundings than my little car.

actually I feel your pain, I have almost been merged into, cutoff, and run off the road. But I just think that its the size of the car rather than the color. and heck most of the time the driver has been doing something else. eating shaving, putting on makeup.. or my personal favorite, this woman was in here escalade smoking and talking on her cell phone at the same time!! I down shifted and got away from her as fast as I could!

Wow - sorry to hear about your second loss!

Here in CA - and I assume everywhere, there is a coverage that waives (pays) the deductible in the case of an uninsured motorist claim - it's quite inexpensive, maybe only $10 or $20 a year. And, if you need it, the best money you will ever spend on car insurance.

Hope your 8 is up and in your hands, good as new, soon!

Sorry about your car . And it's the second time- I really feel for you. I got whacked by a rock this afternoon on the top of the car and almost had a fit- I can't imagine getting hit. I think Outlaw's got the right idea. You need to sue.

And about the women drivers...men and women are just as bad, in different ways. Men are much more agressive, women pay less attention- it all evens out in the end. Not really fair to blame one sex. That would be like me saying that because I've only been hit by men (which is true, bother were seriously at fault) all men are horrible drivers.

Out of the 3 wrecks I have been involved in, where I was driving a silver car, there were zero injuries. None of which were my fault. The 1st was in my previous car, last week of August, RX-8's are in so I go out to drive to the dealer. This dumbass guy, who was obviously drunk, decided at the last minute he wanted to turn right rather than left, so he proceeds to back up, without looking right into my car. His was a kit car which was right hand drive and had a fiberglass body. Needless to say his car was really messed up, and nothing was really wrong with mine. Then he decides he wants to run away, so I chased him down and got his license plate number, saw where he was going, and called the cops, who pretty much said, since you are going to trade your car in anyway, and there really isn't any damage, they weren't going to do anything. The only way they would is if I wanted to get it fixed. Some people........

Sorry to hear about the rerun for you. At least you weren't injured.

Not sure about the science or the statistcs, but my brother had a silver Passat wagon (not an especially small car) that was hit while standing still or in low speed collisions at least 9 times the first year he owned it. There wasn't a piece of that car that wasn't replaced or repainted. Almost everyone of the other drivers jumped out of their cars saying sorry they didn't see him. I know that's no consolation and there's not much to do about being rear ended. Just be careful out there.

I am from TN originally and TN doesn't have a mandatory insurance law due to the insurance companies lobbying against it. I know this because 2 of my dad's friends work for Farm Bureau. When I was stationed in FL they did have the law and if you ever let your insurance expire the company was required to notify the state and then your license was suspended until you went to the DMV and straightened it out.

Hey, my family pet, 15-year old 626 5-door Turbo that got totaled by a red-light-runner was BLUE. Have not seen junkyards dominated by sunlight silver. Sorry for your bad luck but hang in there; you'll be fine from now on.

Tennessee House Bill 1576:

Proof of Automobile Insurance -- Legislation requiring Tennessee drivers to show proof of insurance when pulled over by law enforcement officers for traffic violations has received final approval from the General Assembly.

According to reports, 20 percent of Tennessee's 4.2 million drivers do not carry insurance. Prior law required drivers to only show proof of minimum insurance coverage to the Department of Safety after an accident involving an injury of more than $400 damage. That law set a minimum of $25,000 for bodily injury, $50,000 for each accident and $10,000 for property damage.

The law passed this year would strengthen that statute by imposing a $100 fine for a first offense and loss of their registration if the driver is unable to show they are insured. The penalties would increase for subsequent offenses. (HB 1576 / PC 292, Rinks, effective date: January 1, 2002)

Now if you are stopped, you must show proof of insurance to the traffic officer.

Here in Illinois this is the experience I had with a collision that was not my fault with an uninsured driver.

He got the ticket, both for his fault in the accident and for not having insurance. That was the legal part of the accident.

The Cival part was my insurance going after him and trying to get blood out of the turnip. If they could have gotten the $2800 damage plus my $250 deductable, I would have gotten my deductable back.

Well, needless to say, I never got anything and neither did my insurance company. This did not effect my insurance premium to have had made this claim since it wasn't my fault. I was out a total of $250 which is the deductable.

I'm guessing this is pretty much how it works most everywhere else.

Thank you Meowloud, (have 4 cats myself Two Black, two Holstein), I'm still trying to figure out what I might be able to do. I am going to get an estimate today and see where that will weigh in financially being that I might have to accept the burden. Lawyers can be expensive, and suing to get money out of someone that probably doesn't have it, (I mean they don't even have insurance which is a legal requirement) might not be exactly worth the time on my part. If I do have to pay, I would like them to go to jail for being so irresponsible, or put them to work to pay off their debt, I'm sure some of our bands could use some roadies. It's more than principle though. I take very good care of my car and it looks new on the inside and out. It's been my daily driver since Labor Day, other than the 1st wreck where I waited 2 1/2 weeks for a wheel. I guess if it boils down to it, small claims might be for me, or call Judge Judy.
