might have found a loop hole please let me know

i recently posted about my engine spitting oil out of the leading and trailing spark and i just bought the thing used 3 weeks ago...

i might have found a loop hole... i found that if you dont put 5w-20 in the engine it can wear out the seals and i called the dealership to see what kind of oil they put in my rx8 and they said they put 5w20 that they buy in bulk... i just bought the car and im on a loan so im striving for anything i can get because i cant afford a new motor right now....

do i have a case?

wait...I think you may have mis-typed something? Did you mean that the dealership put something other than 5w20 in your car?

crap sorry yea they put 5w30 in my bad. they buy there 5w30 in bulk and thats what they put in

In the rest of the world mazda recommends 5w30. The owners manual also states that 5w 20 is recommended NOT required. I know you have a problem but being that you got your 8 about 50,000 miles AFTER the warranty expired this 5w20 / 5w30 thing is not going to help you.

isnt this considered a lemon! i mean come on... i understand the miles on the car and that is has no warranty but i have had it for 3 weeks... and the engine went out? it is on record that they did a 21 point inspection so they sold me a car after it went through a certified inspection and the engine went out on me? there has to be something against that

Having worked at a used car lot in my younger days 'certified inspections' are worthless. What do you have written down on paper?? If there is a check box next to ' AS IS ' that means your SOL unless the dealer gave you some other kind of written warranty. As mentioned in your other thread you should consult a attorney that deals with consumer law. Your other option if you have some free time is to picket the dealer with a sign to the effect " XYZ Dealer sells lemons" If there was a way to park the 8 by them with a big sign you might be able to get something out of them.

You still do not know if the engine is bad.

Take is some place that knows rotary engines, not Midas, and find out what it wrong before you waste any more time looking for loopholes.

no... problem has been solved tho... 500 dollars later which is nothing to what i thought i was going to have to spend... i was misinformed on a lot of things going on which led me to misleading the forum... i apologize... car is up and running with new sparks, new oil, a tune up, and a new battery

working at dealerships for over twenty some years here and at the lease they should have offered you was a 30 day wro. and a chance to debait the claims at hand!

Thanks for keeping us posted and glad it was minor maintenance issue. I hate to say it but I told you so in the 1st thread you posted. I had a feeling it was not a blown engine. If you had had it towed to the dealer it would have cost you nothing since it was covered under a flood, tow deflood new plugs battery/starter TSB. Live and learn.

floods are covered even if the car isnt under warranty anymore?

Why would Mazda preform free work on a car out of warranty?? If you take your out of warranty car to a dealer expect a bill. Just find the threads here on how you can De-Flood it yourself. TSB's also only apply for cars in warranty, recalls apply to all cars.

And not all TSB's are required.. they're just a revision to a part or process on a repair. IE: Oil Dipstick change for those that see the 'milk residue' on the dipstick in cold climate areas.

I'm glad that it worked out for you, and I hope that you enjoy the car. Expo there has over 100K Miles on his 8, and he is still motoring happily on the original engine. Best of luck.

son, what i think you need next is to immerse yourself in the library's "law" section so that you can better understand its workings in america...and how to properly manipulate it.

what i got from your efforts of a "court case about your lemon 8" is that your like one of those uninformed americans that think that just by showing up to court you will win...WRONG!!!

if you want to beat these notorious, greedy corporate crooks, then you have to think like them!! and stretch what is said in the big book of law to every little bit of technicality that you can so that it may favor you.

They give you a receipt of what was done in the tuneup? it typically consist of; plugs, wires now adays since there is no distributor cap anymore. Weak battery, and plug fouling might have been the source. But if they flashed the PCM, i hope they listed it. I'm still trying to get a straight answer from my dealer on what flash version they did with the mis-firing they were getting after the engine swap. keep those papers!, glad things are back up and running.

its funny that you called me an amature there mikey cuz the past 3 generations in on my moms side have been lawyers including my mom... haha... and my dad is a cop so i might know a thing or two... i just posted this to see if anyone else could give me some info.. nice job trying to be a smarta$$ tho

Wrong.

Recall is the life of the car AS LONG AS your other parts did not cause the problem. Same thing for Warranty.

TSB means its a known problem to certain parts and the suggest way to repair it. if your warranty is out it WILL NOT be free.
