Lemon Law:

If Mazda cannot square away their engine problems, I am looking into the Lemon Law in Florida. Anyone else out there considering this or has exercised the Lemon Law in their state?

Wish I could help but—like most RX-8 owners—my original engine is fine, didn't need to be replaced, and doesn't have any problems. Sorry.

The car was supposed to be ready yesterday. The work is done and awaiting a road test by the Mazda Tech. I did find out they installed a factory re-build instead of a brand new engine. I was told initially "New Engine".
I am very happy for those that own RX-8's and have no problems. I love the car and is very upsetting that Mazda did not figure the Roto's problems before putting on the market. If this persist, it's move on to a WRX STI.

But they did. The fact that your engine has problems does not mean that all—or even most—Renesis engines have problems. Yet that's what you're implying. I suggest you get your facts straight before implying things that simply aren't true. This isn't Fox News.

Hate Fox News. I have seen six other RX8's at this dealer with the same problem. That is not a good average in anybody's book. When my rep told me this, of course I am concerned. I contacted this forum for answers not to start bullcrap. That is the truth and facts. It would be interesting to see how many Mazda's are in this category of engine failure.

That is good news. I have purchased Mazda's since the early 90's and have had great success with reliability. My 1990 929 gave me well over 100,000 miles with normal wear and tear. I have also had three 626's in our family. Mazda has always treated me very well in handling warranty issues and I am in kind of shock over my RX8 problems, even though the effort is there to fix the problems.

three separate 8s having the same issue doesn't constitute a lemon under any law. you need to show that it was the same issue to the same car at least three times and that's only if your state has the law.

Gotcha. Thanks. Dealer called again. Car is ready but tech wants to perform a cold start in the morning to ensure all is well. I really pray it is. I keep saying it. I love the car.

This is true, the dealership has to attempt to fix the same problem at least 3 times. Just cause multiple cars are having the same problem has nothing to do with it being a Lemon.

In most states the car being out of service for 30 days in the first year or two of ownership is considered a lemon as well. I believe also 6-8 repairs done to the entire car during the warranty period can constitute a lemon as well.

Florida lemon law:

There must be three repair attempts for the same defect or condition, OR at least 15 cumulative calendar days out of service for one or more defects or conditions, before submitting the Motor Vehicle Defect Notification (MVDN). If you do not have the required number of repair attempts or days out of service, then continue to take the vehicle to the dealer for repairs.

If your complaint is based on the vehicle being out of service for 15 or more days the manufacturer or its authorized agent has the opportunity to inspect or repair the vehicle. If the vehicle still does not conform to the warranty for a total of 30 or more days and the manufacturer has had the opportunity to repair, you are entitled to request arbitration.

... in short.. it's highly unlikely they will replace your engine 3 times within warranty period (4 year 48000 miles??)

Thank you for this. I just want my RX-8 to perform as it had prior to taking the car in for the 30,000 mile service. I feel like I am putting on a glove when I get into this car and love the rotary performance. Drives like you are on rails. Maybe I'll get a Peach today instead of a Lemon.

Another engine requires another break-in period. Don't expect to run the hell out of it until it is broken in or you will be bringing it back for another replacement and you'll be coming back here blaming Mazda again.

Hey PaPaBear, I've started Lemon Law litigation here in Ohio with my 2004 "8". The car has been back to the dealership 15 or more times since April 2006. A simple check engine light keeps appearing which has caused the dealership to repair / replace everything up through the intake manifold. The replacement of the manifold took 8 work-days to complete and the car came back to me with significant cabin heating issues as well as engine noise issues. Using a temperature probe I borrowed from work the shipt boot rang up 145 degrees F and the console stood at 125 degrees F. The warranty has been extended twice, this time to 60K miles, but this only covers the power train. Check engine has come on several more times since the car has been in the 50k - 60k warranty range (powertrain only). Dealership will not fix it under warranty eventhough the problems was never corrected from the orginal warranty period of 36K. I cannot re-sell it with the light on or pass an emissions test.
