Is it a lemon?

Unhappy Is it a lemon?

Mazda had my car for over month for grinding noise in the transmission while shifting gears, I finally got it back on 12/30/03. I’m still having problems with the transmission, now some of the gears won’t go in sometimes or once the gear is in it won’t let the gear go, I have to wiggle the stick to try to remove the gear. It did this to me in the morning and was stuck in reveres for 2min with oncoming traffic behind me (Very Embarrassing). I read the California Lemon-Aid booklet on the internet and it says that the dealer must have a certain amount of times to fix the problem or it’s been at the shop for more than 30days.

Is this considered a lemon? if it is how do I go about getting this issue resolved?

the california lemon law is 4 times for the same problem or if they have the car for more than 30 days to fix.

time to make lemonade.

Don't know the exact wording on the CA lemon law, but the IN lemon law states 30 BUSINESS DAYS as opposed to just 30 days. So weekends don't count. But with more and more dealers doing Sat hours, perhapse at least that day counts? You gotta be close.

Check out http://www.defect.com/ or simply type in Lemon Law into www.yahoo.com and you shoudl find good info. Remember if the dealer bawks, just go straight to a lawer that specializes in these cases.

Just go ahead and file your claim under the lemon law. Make Mazda and the state figure out if it's a lemon. At least you can put the ball in their court.
